MINUTES <br />CITY COUNCIL <br />DECEMBER 22, 2008 <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />CITY The City Attorney reported that his office received a call from a law firm <br />ATTORNEY in Nevada inquiring about the environmental warranty provisions that the <br />REPORT City imposed as part of the land transaction with Ed Dropps in the area of <br />Heather Oaks Townhomes. The Attorney commended the City Council <br />on this work, noting the attention it has received from other entities. <br />CVS The City Adminishator presented a proposed Development Agreement <br />DEVELOPMENT with CVS Pharmacy addressing the restricted access issue on County <br />AGREEMENT Road C. He noted that Ramsey County will be upgrading Rice Street as <br />well as County Road C in the future and there will likely be the <br />installation of medians at this intersection. The County has indicated that <br />the decision on whether or not to install a median on County Road C will <br />be based on a number of factors, including accident data. This agreement <br />will not require a restricted access at this time. Should accident data or the <br />future median improvements associated with upgrades to Rice Street <br />warrant the restricted access, CVS is agreeing to do so at their cost. The <br />Agreement ensures that CVS is aware of the potential of these future <br />restrictions. <br />Jon Lennander, representing CVS, indicated that they are accepting of this <br />agreement. <br />Allan inhoduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2008-I2-330 -APPROVING THE <br />DEVELOPMENT AGREEMENT WITH CVS AS PRESENTED BY <br />THE CITYADMINISTRATOR AND AUTHORIZING THE MAYOR <br />AND CITYADMINISTRATOR TO EXECUTE ON BEHALF OF THE <br />CITY <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />COMP PLAN The City Planner reported that the Metropolitan Council has granted the <br />UPDATE City an extension for submitting its Comprehensive Plan update. He <br />further noted the joint meeting of the City Council and the Planning <br />Commission on January 28"' to review the draft plan. <br />24 <br />
