<br />City staff does not find this proposal to be detrimental to the public health, welfare, or injurious <br />to other property in the territory in which the property is situated as this development is internal <br />to itself and all units will be affected by this change. This does not impact adjacent properties. <br /> <br />In addition, under Minnesota law, we find that practical difficulty has been met, meaning (1) the <br />property owner proposes to use the property in a reasonable manner permitted by the ordinance, <br />(2) the owner's plight is due to circumstances unique to the property not created by the property <br />owner. <br /> <br />The request for variance is not based on an economic hardship and solely based on the physical <br />aspects of the configuration of the site and is the best and highest use of the property. <br /> <br />Public Hearing: <br />A Final Plat, Rezoning, and Variance requires a Public Hearing and the City Council will open the <br />hearing at their October 26, 2022 meeting to take comment from the public. At that time, they will <br />consider comments from the public and application from the Planning Commission. Public hearing <br />notice letters were sent to addresses within 350 feet of the parcel as well as to the Pioneer Press <br />for publication. <br /> <br />Next Steps: <br />The proposed development will follow the process schedule below: <br />o 2023 – Planning Commission and City Council – Final Plat 2nd Addition <br />o 2023/2024 – Planning Commission and City Council – Final Plat 3rd Addition <br /> <br />RECOMMENDED ACTIONS <br />1. Approve the Final Plat 1st Addition for Pioneer Commons, contingent upon the following: <br />a. Incorporating City Engineer comments into Final Plat submittal <br />b. Incorporating RWMWD comments into Final Plat submittal <br />c. Incorporating Ramsey County comments into Final Plat submittal <br />d. Execution of the Development Agreement <br /> <br />2. Adopt Ordinance 868 amending the Zoning Map of the City of Little Canada, Rezoning <br />certain 5 parcels listed of property from R-1 Low Density Residential to R-2 Medium <br />Density Residential and approve publication of a summary ordinance. <br />a. PID# 05-29-22-21-0024 <br />b. PID# 05-29-22-21-0029 <br />c. PID# 05-29-22-21-0030 <br />d. PID# 05-29-22-21-0031 <br />e. PID# 05-29-22-21-0032 <br /> <br />3. Approve a Variance for Pioneer Commons, for the following setbacks: <br />a. Front Yard Setbacks from 25 feet to 20 feet. <br />b. Rear Yard Setback from 30 feet to 20 feet. <br /> <br />4. Authorize City Staff to execute Development Agreement, contingent on: <br />a. Incorporating City Attorney comments into the Development Agreement
