MINUTES <br />CITY COUNCIL <br />JANUARY 28, 2009 <br />TEMO The City Administrator reviewed the Code Enforcement Officer's <br />SUNROOMS January 22, 2009 report relative to code compliance issues at Temo <br />CODE Sum•ooms at 2905 Country Drive. It was noted that after several <br />COMPLIANCE attempts to achieve code compliance under the PUD Permit, the gazebo <br />has been removed from the property, but the two display trailers remain on <br />the property. The Administrator outlined the options available to the City <br />which include continuing contact with Temo Sunrooms to achieve <br />compliance, issuing citations for the violations, or pursuing revocation of <br />the PUD Permit. <br />It was the consensus of the Council to request that Mr. Maietta, Temc <br />Sunrooms, appear before the Council in February to discuss this non- <br />compliance issue. Should those discussions not prove successful, the <br />Council indicated their willingness to pursue revocation of the PUD <br />Permit. <br />MARCH Mr. Keis introduced the following resolution and moved its adoption: <br />MEETING <br />CHANGE RESOLUTION NO.2009-1-29 -RESCHEDULING THE MARCH 9, <br />2009 REGULAR COUNCIL MEETING TO TUESDAY, MARCH 10, <br />2009 AT 7:30 P.M. <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (1) Montour. Resolution declared adopted. <br />CALL FOR Mr. James Monge III, League of Minnesota Cities attorney representing <br />CLOSED the City in the Valor Enterprises litigation, advised the City Council to <br />SESSION - call for a closed session to discussion settlement discussions and <br />VALOR negotiations pursuant to State Statutes. He noted that there will be no <br />LITIGATION decisions made at this closed session and no other business will be <br /> discussed. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTIONNO. 2009-1-30 - TEMPORARILYADJOURNING THE <br />REGULAR COUNCIL MEETING AND CONVENING INTO CLOSED <br />SESSION <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0).
