MINUTES <br />CITY COUNCIL <br />FEBRUARY 25, 2009 <br />about water in her basement. Montour noted that the City Engineer will <br />review all grading and drainage plans to ensure they are adequate and the <br />development does not cause drainage problems. <br />The City Administrator noted that there will be additional cost in <br />reviewing custom graded lots, and recommended that a provision be <br />included in the Development Agreement making the developer responsible <br />for these review costs. The City Planner also suggested that the <br />Development Agreement include a provision outlining the terms and <br />conditions for final platting of Lots 3, 4, and 5 given the timeline <br />suggested by the developer. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Montour, seconded by McGraw, the public hearing was <br />closed. <br />McGraw asked about the issue of sidewalks as well as about the tennis <br />court. The City Planner indicated that the Parks Commission will be <br />taking up the issue of sidewalks at their next meeting. I-Ie noted that the <br />County has required the dedication of additional right-of--way along <br />Edgerton Street. The Council was informed that the tennis court would <br />remain until all the lots were final platted. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-2-43 -APPROVING THE PRELIMINARY <br />PLAT FOR HUOT ADDITION SUBJECT TO COMPLIANCE WITH <br />THE RECOMMENDATIONS OF THE CITY PLANNER, CITY <br />ENGINEER, PLANNING COMMISSION, AND PARKS & <br />RECREATION COMMISSION, AND SUBJECT TO THE <br />IMMEDIATE REMOVAL OF THE ONE NON-CONFORMING SHED <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />APPEAL OF Montour opened the Public Hearing to consider an appeal made by <br />ZONING William and Renee Galvin of the City's Zoning Code definition which <br />CODE limits single family size to no more than three umrelated individuals in <br />DEFINITION - order to accommodate occupancy of asingle-family home by four <br />GALVIN unrelated individuals. The home in question is located at 882 Westwind <br /> Drive. <br />
