<br /> <br /> <br /> <br /> <br /> <br /> <br />January 5, 2023 <br /> <br /> <br />RE: Easement Acquisition – Compensation Offer <br />Parcel: 3071 Payne Avenue <br />Thunder Bay Trail Extension <br /> City of Little Canada <br /> <br />Dear Scott & Julie Nordstrom, <br /> <br />As part of the upcoming Thunder Bay Trail Extension Project, the City is requesting rights to a <br />portion of your property through the acquisition of a permanent trail easement. A permanent trail <br />easement is an agreement between the City and property owner allowing for long-term access <br />to a portion of the property for the purposes of a public-use trail. This easement runs with the <br />land and would continue into perpetuity until such time the City decides to vacate the easement. <br /> <br />The enclosed figure depicts the trail easement that the City intends to acquire on your property. <br /> <br />Under Minnesota law, you are entitled to fair compensation for the proposed trail easement and <br />any financial damages incurred as a result of work done in the easement. Financial damages <br />typically include improvements damaged or removed in the easement (such as trees, fences, <br />sheds, etc.). All disturbed turf within the easement will be regraded, restored with fresh topsoil, <br />and re-established with turf or native plantings at the City’s expense. We have analyzed the <br />proposed easement and offering the following as compensation: <br /> <br />1. None <br /> <br /> Total Compensation: $15,603 <br /> <br /> <br />Special Considerations - Screening <br />Due to the proposed use of the trail easement, you have requested that screening be installed <br />with the project. As such, project staff is proposing a low earthen berm with vegetated screening <br />as depicted in the enclosed landscaping figure. Project staff can have this installed with the <br />project at no upfront cost to you. However, after the initial 2-year warranty and acceptance <br />period, long-term care, maintenance, and ownership of the landscaping/vegetation will be the <br />property owner’s. <br /> <br />
