PERMANENT TRAIL EASEMENT AGREEMENT FOR PROPERTY <br />AT 3071 PAYNE AVENUE, <br />LITTLE CANADA, RAMSEY COUNTY, MINNESOTA <br />THIS PERMANENT TRAIL EASEMENT AGREEMENT (“Easement”) is made, granted <br />and conveyed this _____ day of ____________, 2023, by and between Scott W. Nordstrom and <br />Julie K. Nordstrom, husband and wife and collectively referred to as the “Landowner”, and the City <br />of Little Canada, a Minnesota municipal corporation, hereinafter referred to as the “City”. <br />The Landowner owns the real property situated within Ramsey County, Minnesota as <br />described on the attached Exhibit A (hereinafter “Landowner’s Property”). <br />For good and valuable consideration and for and in consideration of payment by the City to <br />the Landowner in the amount of $15,603, the receipt and sufficiency of which is hereby <br />acknowledged, Landowner does hereby grant and convey unto the City, its successors and assigns, <br />forever, a permanent easement for trail and for purposes and uses incident and related thereto, <br />including, without limitation, the construction, maintenance, repair and replacement of trail <br />improvements upon the following described premises (the “Easement Area”) situated within <br />Ramsey County, Minnesota, to-wit: <br />See the attached legal description and depiction on Exhibit B, incorporated herein by <br />reference, <br />EXEMPT FROM STATE DEED TAX <br />The rights of the City include the right of the City, its contractors, agents and servants, at the <br />sole cost of the City: <br />a.) to enter upon the Easement Area at all reasonable times for the purposes of <br />construction, rehabilitation, reconstruction, inspection, and restoration relating to the <br />purposes of this Easement; and <br />b.) to maintain the Easement Area in a manner to allow unobstructed public use of the <br />trail improvements; and <br />c.) to remove from the Easement Area trees, brush, herbage, aggregate, undergrowth
