STAFF REPORT

TO: Mayor Fischer and Members of the City Council

FROM: Bill Dircks, Public Works Director

DATE: February 8, 2023

RE: Delegated Contract Process Agreement with MnDOT

ACTION TO BE CONSIDERED:
Motion to approve agreement and resolution supporting the delegated contract process
agreement between the City of Little Canada and MnDOT.

BACKGROUND:
There are projects in the city that are eligible for federal funding. An example of such a project
is the potential interchange upgrade at Little Canada Road, Country Drive, and 35E. MnDOT is
also involved with these types of projects and has a process for working with the federal
government to acquire federal funding. Because of this, it is easier and more efficient for local
governments to allow MnDOT to act on behalf of the city when seeking federal funding.

A delegated contract process agreement covers the roles and responsibilities associated with
federal aid funds and allows for MnDOT to act as the City’s agent in accepting these funds for
construction projects. The agreement is ongoing and is updated from time-to-time with changes
and other updates to the language of the agreement. That is what precipitated this update to the
agreement. There were six sections added to the agreement to reflect changes in the construction
contract environment.

STAFF RECOMMENDATIONS:
Staff recommends approving the agreement and resolution supporting the delegated contract
process agreement between the City of Little Canada and MnDOT.

ATTACHMENTS:
• Delegated Contract Agreement
• Resolution Approving Contract
