MINUTES <br />CITY COUNCIL <br />MARCH 30, 2009 <br />additional information on the fee payment process, etc. The Administrator <br />noted that the fee schedule was mailed to property owners along with the <br />notice of this evening's meeting. Those fees would remain the same and <br />the schedule will not be resent. <br />The Administrator noted that the veto period runs for 45 days. If the fee <br />resolution is vetoed, any fee payments made will be refunded to property <br />owners. <br />A property owner asked when the Administrator will know if the project <br />qualifies for County money. The Administrator thought he would know <br />tomorrow and would provide that information to the association board as <br />well as include it in the mailed notice. <br />There were no other comments from those present. <br />Upon motion by Keis, seconded by Montour, the public hearing was <br />closed. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-3-76 -ESTABLISHING HOUSING <br />IMPROVEMENT FEE FOR HOUSING IMPROVEMENT AREA NO. <br />3, FLEUR ROYALE CONDOMINIUMS, PURSUANT TO <br />MINNESOTA STATUTE 428A.I4 THE TOTAL AMOUNT OF <br />WHICH IS $525,374.00 <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4). <br />Nays (0). <br />Abstains (1) McGraw. Resolution declared adopted. <br />CANABURY Mayor Blesener opened the Public Hearing to consider the proposed <br />CONDOMINIUM fees to be imposed and collected for improvements and repairs to <br />HIA FEE the Canabury Condominium housing units within Housing <br />HEARING Improvement Area (HIA) No. 2. <br />The City Administrator reviewed a detailed presentation on the basis in <br />law for and mechanics of Housing Improvement Areas. He then reviewed <br />the specific issues relative to the Canabury Condominium HIA. The City <br />Administrator indicated that his recommendation to the Council this <br />evening is to adopt the Canabury Condominium HIA fee schedule. The <br />Canabury Condo owners will have a 45 day veto period to overturn the fee <br />schedule adoption. If 35% of the tax capacity ownership sign a veto <br />petition, the HIA process is stopped. <br />
