<br />sprinkling, water, power and communications equipment, systems and apparatus; all water coolers and
<br />water heaters; all fire prevention, alarm and extinguishing systems and apparatus; all cleaning equipment;
<br />all lift, elevator and escalator equipment and apparatus; all partitions, shades, blinds, awnings, screens,
<br />screen doors, storm doors, exterior and interior signs, gas fixtures, stoves, ovens, refrigerators, garbage
<br />disposals and compactors, dishwashers, cabinets, mirrors, mantles, floor coverings, carpets, rugs,
<br />draperies and other furnishings and furniture installed or to be installed or used or usable in any way in
<br />the operation of any Improvements or appurtenant facilities erected or to be erected in or upon the Land;
<br />and every renewal, replacement or substitution therefor, whether or not the same are now or hereafter
<br />attached to the Land in any manner; all except for any right, title or interest therein held by any tenant of
<br />any or all of the Land or the Improvements, or by any other person, so long as such tenant or other person
<br />is not a party hereto or bound, with respect to such right, title or interest, by the provisions hereof (it being
<br />agreed by the parties hereto that all personal property owned by the Grantor and placed by it on the Land
<br />shall, so far as permitted by law, be deemed to be affixed to the Land, appropriated to its use, and covered
<br />by this Mortgage), and
<br />TOGETHER WITH all of the Grantor’s right, title and interest in and to any and all easements
<br />and appurtenances, including, without limitation, any easements and agreements which are or may be
<br />established to allow satisfactory ingress to, egress from and operation of the Land and the Improvements,
<br />and
<br />TOGETHER WITH any and all judgments, awards of damages (including but not limited to
<br />severance and consequential damages), payments, proceeds, settlements or other compensation heretofore
<br />or hereafter made, including interest thereon, and the right to receive the same, as a result of, in
<br />connection with, or in lieu of (a) any condemnation, either temporarily or permanently, (b) any change or
<br />alteration of the grade or widening of any street or road, and (c) any other damage, destruction, or injury
<br />to, or decrease in value of, the Land or the Improvements or any part thereof, to the extent of all Secured
<br />Obligations at the date of receipt by the Beneficiary of any such judgment, award of damages, payment,
<br />proceeds, settlement or other compensation, including interest thereon, and of the reasonable counsel fees,
<br />costs and disbursements, if any, incurred by the Beneficiary in connection with the collection of such
<br />judgment, award of damages, payment, proceeds, settlement or other compensation, including interest
<br />thereon, and
<br />TOGETHER WITH all of Grantor’s rights in and to policies of insurance including any and all
<br />payments, proceeds, settlements or other compensation heretofore or hereafter made, inc luding any
<br />interest thereon, and the right to receive the same, from any and all insurance policies covering the Land
<br />or the Improvements or any portion thereof, and
<br />TOGETHER WITH all right, title and interest of the Grantor in and to the Management
<br />Agreement by and between the Grantor and Halverson and Blaiser Group, Ltd. dated as of ________,
<br />2023, and any modifications, amendments, extensions, renewals, replacements or substitutions thereof
<br />thereafter made, and
<br />TOGETHER WITH all contract rights (including any contract deposits), but not any contract
<br />obligations or liabilities, relating to or arising out of any agreement to sell, transfer, assign, convey or
<br />encumber the Land, the Improvements, any portion thereof, any interest therein, and
<br />TOGETHER WITH all plans and specifications, surveys, reports, diagrams, drawings, service
<br />contracts, accounting records, invoices, change orders, licenses, authorizations, certificates, variances,
<br />approvals and other permits necessary or appropriate to permit the construction, reconstruction, repair or
<br />alteration, addition, improvement, use, operation and management of the Land and the Improvements, and
