From time to time, within ten (10) <br />days after the written request of Controlling Person, Borrower shall deliver to Controlling Person any and <br />all of the following information and documents, to the extent applicable to the construction or renovation <br />of the Project Facilities, that Controlling Person may request, all in forms acceptable to Controlling Person, <br />as applicable: <br />(a) Current Plans and Specifications for the Improvements certified by the Architect <br />as being complete and accurate, and a line item cost breakdown for the proposed construction <br />and/or rehabilitation of the Improvements; <br />(b) A current, complete and correct list showing the name, address, telephone number <br />and license information of each contractor, subcontractor and material supplier engaged in <br />connection with the construction and/or rehabilitation of the Improvements, and the total dollar <br />amount of each contract and subcontract (including any changes) and the scope of work involved, <br />together with the amounts paid through the date of the list and all other information reasonably <br />requested by Controlling Person; <br />(c) True and correct copies of the most current versions of all executed contracts and <br />subcontracts with each party identified in the list described in clause (b) above, including any <br />changes; <br />(d) True and correct copies of all grading, foundation, building and all other <br />construction permits, licenses and authorizations from all applicable Governmental Authorities or <br />third parties necessary for the construction and/or rehabilitation of the Improvements and the <br />operation of, and access to, the Project; <br />(e) Copies of (i) owner/architect/contractor project meeting minutes; (ii) requests for <br />information (RFI), submittal logs, proposed change orders (PCO), and change order logs; (iii) <br />independent test results, (iv) quality inspection reports; and (v) anticipated cost reports, buy-out <br />logs and Major Contracts; <br />(f) A construction schedule showing the progress of construction or rehabilitation, as <br />the case may be, and the projected sequencing and completion times for uncompleted Work, all as <br />of the date of the schedule; and <br />(g) Any update to any item described above which Borrower may have previously <br />delivered to Controlling Person. <br />(h) Borrower expressly authorizes Controlling Person to contact Architect, Contractor <br />or any contractor, subcontractor, material supplier, surety or any Governmental Authority to verify <br />any information disclosed in accordance with this Section 9.14. Controlling Person shall give <br />notice to Borrower of any such contacts, provided that neither Controlling Person nor Funding <br />Lender shall incur any liability to Borrower by reason of the failure to give such notice, and <br />Borrower’s obligations under the Borrower Loan Documents shall not be affected in any manner <br />by any failure to give such notice. The Construction Contract shall require the Contractor to <br />disclose such information to Funding Lender and Controlling Person. Any defaulting architect, <br />contractor, subcontractor, material supplier or surety shall be promptly replaced, and Borrower <br />shall promptly deliver all required information and documents to Controlling Person and Funding <br />Lender regarding each replacement architect, contractor, subcontractor, material supplier and <br />surety. Controlling Person may disapprove any architect, contractor, subcontractor, material <br />supplier, surety or other party whom Controlling Person in its reasonable judgment may deem
