77060900v2 <br /> <br /> <br /> <br /> B-9 <br /> <br />Architect’s Requisition Certificate <br />Application for Payment No.________ <br />TO: Allianz Life Insurance Company of North America (“Funding Lender”) <br /> <br />R4 Servicer LLC (“Controlling Person”) <br />FROM: Kaas Wilson Architects, LLC (“Architect”) <br />RE: Construction of Lica Apartments (the “Project Facilities”) by Little Canada Phase II <br />Limited Partnership (“Borrower”). <br /> <br />We are the architect for the Project Facilities and, to induce the Controlling Person to approve <br />disbursements of Bond proceeds and other amounts by the Funding Lender to assist in funding construction <br />of the Improvements, and knowing that the Controlling Person will rely on this cert ificate in doing so, we <br />hereby certify as follows: <br />1. We inspected the Project Facilities on _____________, 20__ and found the status of Work at the <br />Project Facilities on that date and the progress made on the Project Facilities since our last <br />certificate to you dated _____________, 20__ to be as follows: [substantially in <br />accordance with the approved, as amended and approved, plans and specifications], [non-compliant <br />with the approved plans and specifications], [other – describe here] <br />2. We delivered the Plans and Specifications for the Project Facilities, copies of which have been <br />delivered to you (the “Plans and Specifications”). We have made no changes to the Plans and <br />Specifications except as you have approved in writing. There are no pending change orders or <br />construction change directives except as provided in the current Pending Change Order and Change <br />Order Log. <br />3. All Work to date has been done in accordance with the Plans and Specifications and in a good and <br />workmanlike manner. All materials and fixtures usually furnished and installed or stored on site at <br />the current stage of construction have been furnished, installed or stored on site. All of the Work <br />to date is hereby approved except as follows: <br />4. We have examined the requisition being submitted herewith to you by Borrower, which requisition <br />includes an Application for Payment from Eagle Building Company, LLC (“Contractor”) <br />respecting construction of the Improvements. The payment so applied for by Contractor does not <br />exceed (when added to the payments heretofore applied for by and paid to Contractor) __% of the <br />value of labor and materials incorporated into the Improvements. <br />5. All permits, licenses, approvals and the like required to complete construction of the Improvements <br />have been validly issued by the appropriate authorities and are in full force and effect, and there is <br />no violation of any of the provisions thereof or of any Legal Requirements applicable to the Project <br />Facilities of which we have notice or knowledge as of the date hereof except as follows: <br />6. Access to and egress from the Project Facilities and all improvements to be constructed thereon are <br />in accordance with all applicable Legal Requirements. Water, drainage and sanitary sewerage <br />facilities and telephone, gas and electric services of public utilities are or are due to be installed in
