STAFF REPORT <br />TO: Chair Kwapick and Planning Commission Members <br />FROM:Corrin Wendell, Community Development Director <br />DATE: Thursday, October 13, 2022 <br />RE: Final Plat/Variance/Rezoning– U.S. Home, LLC and Lennar – Case #1415 <br />COVER MEMO <br />BACKGROUND <br />To consider recommending approval to the City Council for the Final Plat 1st Addition for U.S. <br />Home, LLC, and Lennar, Rezoning from R-1 Low Density Residential to R-2 Medium Density <br />Residential, and a Variance for the front and rear yard setbacks of the townhomes. <br />On March 24, 2022, Lennar held a Neighborhood Meeting at the Little Canada Elementary to <br />discuss the development and answer questions from the public. <br />At the May 5, 2022 Planning Commission meeting, the Planning Commission reviewed the <br />Preliminary Plat, Rezoning, and Variance request and recommended approval to the City <br />Council. <br />At the May 11, 2022 City Council Meeting and public hearing, the City Council reviewed the <br />Preliminary Plat, Rezoning, and Variance request. This item was tabled to allow for Site Plan <br />changes. <br />At the May 25, 2022 City Council meeting, the City Council voted to approve the Preliminary <br />Plat and move forward with the Final Plat, Rezoning, and Variance phases. Based on Council <br />discussion and public comment, Lennar provided an updated Site Plan that showed additional <br />circulation to address concerns about traffic, city road connections, and internal connections <br />within the private streets of the development. <br />The City process and requirements for Preliminary and Final Plats are outlined in the Subdivision <br />Ordinance, Section 1005. The Planning Commission reviews each of these requests and makes a <br />recommendation to the City Council. The City Council then reviews and makes a final <br />determination for the requests. Sometimes Preliminary and Final Plats are reviewed together and <br />sometimes they are reviewed separately, typically for larger parcels with more complex detail. <br />This development proposal will have a Preliminary Plat stage and a Final Plat stage for approval <br />of the 1st, 2nd, and 3rd Additions. Each Final Plat Addition will have a recommendation from the <br />Planning Commission and a final determination from the City Council to obtain all necessary <br />approvals. <br />The proposed development will follow the Final Plat process below: <br />o October 13, 2022 – Planning Commission Final Plat 1st Addition, Variance and Rezoning <br />o October 26, 2022 – City Council Final Plat 1st Addition, Variance, Rezoning, and <br />Development Agreement <br />o 2023 – Planning Commission and City Council – Final Plat 2nd Addition <br />o 2023/2024 – Planning Commission and City Council – Final Plat 3rd Addition
