Subject to the <br />comments below, it is legally acceptable in form and content and is ready for presentation to the <br />City Council. <br />3200.040 (1) -required lease language. I compared the MCI'A draft to the language in the final <br />draft, and combined the two. The "affiliated with the resident" language in the draft appears <br />likely to create enforcement difficulties; "guest" is ah•eady broad but is definite enough to be <br />used in an eviction proceeding. The underlining and other emphasis, along with the bold <br />warnings and "understanding" at the end of the MCPA draft is also important in the context of <br />housing court. The City's "disorderly use" add-on is a good idea, and I added similar emphasis <br />and warning to allow that pzovision to operate in housing court. I moved the definitions back up <br />into the main body of the Crime-Free language, recognizing that this language will be included <br />in a standard residential lease, and may get lost in the shuffle if it includes too many parts. <br />3200.080 Code of Conduct. Adjusted the statutory citation for assault to include domestic <br />assault (609.2242) <br />3200.100 (C,) and (D): inserted reference to proposed licensing procedure ordinance, slotted in as <br />Section 800 of the City Code. <br />3200.110 (C}: Inserted a reference to 800.010(D) regarding appeals of administrative decisions <br />and removed a sentence that duplicated an part of the new 800.010(D). <br />Respectfully yours, <br />KELLY & LEMMONS, l'.A. <br />Trevor S.
