E. Fourth Violation (4 incicletzts withizz 36 morxths). If a fourth incident of disorderly use <br />of the Renta] Dwelling Unit occurs involving the same Tenant within thirty-six (36) <br />months after the first violation, the license for that Rental Dwelling or the Rental <br />Dwelling Unit may be denied, revoked or suspended pursuant to 3200.100.A. In addition, <br />the Council may consider imposing a Tier 2 penalty pursuant to 3200.100.B. <br />F. Fifth Violation (S iecidents w[[hitz 48 mozzths). If a fifth incident of disorderly use of <br />the Rental Dwelling Unit occurs involving the same Tenant within forty-eight (48) <br />months after the first violation, The license for that Rental Dwelling or the Rental <br />Dwelling Unit maybe denied, revoked or suspended pursuant to3200.100.A. In addition, <br />the Council may consider imposing a Tier 3 penalty pursuant to 3200.1 OO.B. <br />3200.090. STAR PROGRAM. To promote crime-fi•ee housing, the City encourages <br />Rental Property Owners to voluntarily participate in the STAR Program by fulfilling the <br />program elements each year of licensure. A STAR Program application form must be <br />completed and submitted with the license application in order for an owner to participate <br />in the STAR Program. <br />A. More Than 3 Dwelling Units. For Owners with more than three (3) Dwelling <br />Units, the following criteria set forth the STAR requirements for each participation level. <br />(1) Minimum STAR participation - To qualify for Minimum STAR participation, <br />Owners or Managers shall comply with the following: <br />a. Use the Crime Free/Drug Free Housing Lease Language as set forth in this <br />ordinance. <br />b. Provide the City a copy of rental criteria regarding Tenants with criminal <br />backbriounds. <br />c. Upon request, make available a copy of Third Party Backlnound Check <br />procedures for screening of prospective and existing Tenants and <br />Occupants. <br />d. Actively pursue the eviction ofnon-compliant Tenants. <br />e. Within twelve (12) months o£ joining the STAR program, complete at least <br />Phase One of the Minnesota Crime Free Rental-Housing Prog~am. The <br />Phases of Minnesota Crime Free Rental Housing Program are: <br />• Phase One. Management 'T'raining -Resident Managers <br />and/or Owners attend an eight-hour seminar presented by <br />police, fire, pubtic housing and others. <br />• Phase Two. Security Assessment -This phase will certify <br />that the rental property has met the security requirements <br />for the Tenant's safety. <br />• Phase Three. Resident Training - A meeting is held for the <br />residents where crime watch and crime prevention <br />teclmiques axe discussed. <br />12 <br />
