<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Fischer and Members of City Council <br /> <br />FROM: Corrin Wendell, Community Development Director <br /> DATE: Wednesday, November 29, 2023 <br /> RE: Code Enforcement Abatement Action at 2975 Arcade Street <br /> <br />ACTION TO BE CONSIDERED: <br />The Council is asked to consider a motion to authorize code enforcement abatement action at 2975 <br />Arcade Street, PID 052922140044. <br /> <br />BACKGROUND: <br />The subject property has been in violation of the City Code since complaints were first received in March <br />of 2022. Over this time, City staff has been working with the owner of the property to become compliant. <br />In April, 2023 the subject property received a notice of foreclosure. The City’s Code Enforcement <br />Officer requested compliance from the property owner on numerous occasions with limited success. As <br />of November 22nd, 90% of the items from the front of the property has been removed, except for five <br />vehicles. Following the adoption of Chapter 3301 into the City Code, City staff began issuing violation <br />notices including the following: <br /> <br />• 1st Violation 8/9/2023, posted & mailed. <br />• 2nd Violation 8/24/2023, posted & mailed. <br />• 3rd Violation (w/ $100.00 fine) 9/8/2023, posted & mailed. <br />• 4th Violation (w/ $250.00 fine) 9/25/2023, posted & mailed. <br />• The bank contacted the City to pay fines. <br />• Fines were not paid to the City. <br /> <br />As of November 22nd, the property owner has made progress on the front yard and much is cleaned up. <br />They were informed that the City Council may take action on abatement. <br /> <br />The following Chapters of the City Code describe the nuisance violations: <br /> <br />601. NUISANCE. <br /> <br />601.030. PUBLIC NUISANCES AFFECTING HEALTH OR SAFETY. The following are hereby <br />declared to be public nuisances affecting health or safety: <br /> <br />(g) An accumulation of tin cans, bottles or trash or debris of any nature or description, and the throwing, <br />dumping, or depositing of any dead animals, manure, garbage, waste decaying matter, ground, sand, <br />stones, ashes, rubbish, tin cans, or other material of any kind on private property; <br />
