STAFF REPORT TO: Mayor Fischer and Members of City Council FROM: Corrin Wendell, Community Development Director DATE: Wednesday, November 29, 2023 RE: Code Enforcement Abatement Action at 2975 Arcade Street ACTION TO BE CONSIDERED: The Council is asked to consider a motion to authorize code enforcement abatement action at 2975 Arcade Street, PID 052922140044. BACKGROUND: The subject property has been in violation of the City Code since complaints were first received in March of 2022. Over this time, City staff has been working with the owner of the property to become compliant. In April, 2023 the subject property received a notice of foreclosure. The City’s Code Enforcement Officer requested compliance from the property owner on numerous occasions with limited success. As of November 22nd, 90% of the items from the front of the property has been removed, except for five vehicles. Following the adoption of Chapter 3301 into the City Code, City staff began issuing violation notices including the following: • 1st Violation 8/9/2023, posted & mailed. • 2nd Violation 8/24/2023, posted & mailed. • 3rd Violation (w/ $100.00 fine) 9/8/2023, posted & mailed. • 4th Violation (w/ $250.00 fine) 9/25/2023, posted & mailed. • The bank contacted the City to pay fines. • Fines were not paid to the City. As of November 22nd, the property owner has made progress on the front yard and much is cleaned up. They were informed that the City Council may take action on abatement. The following Chapters of the City Code describe the nuisance violations: 601. NUISANCE. 601.030. PUBLIC NUISANCES AFFECTING HEALTH OR SAFETY. The following are hereby declared to be public nuisances affecting health or safety: (g) An accumulation of tin cans, bottles or trash or debris of any nature or description, and the throwing, dumping, or depositing of any dead animals, manure, garbage, waste decaying matter, ground, sand, stones, ashes, rubbish, tin cans, or other material of any kind on private property;
