MINUTES CITY COUNCIL JANUARY 24, 2024 6 RESOLUTION NO. 2024-1-12 – APPROVING A PURCHASE AGREEMENT FOR THE ACQUISITION OF PROPERTY LOCATED AT 2884 AND 2886 CENTERVILLE ROAD AS REVISED The foregoing resolution was duly seconded by Kwapick. Ayes (5). Nays (0). Resolution declared adopted. APPROVE PLANS & AUTHORIZE BIDDING FOR 2024 STREET IMPROVEMENT PROJECTS ON JACKSON STREET & COUNTRY DRIVE The City Engineer explained tonight the Council is asked to consider approving the plans and authorize bidding for the 2024 street improvement projects for Jackson Street and Country Drive. He provided a brief overview identified the project areas, proposed road and utility improvements, project funding, estimated costs and financing, special assessments and assessable properties, preliminary assessment rolls, and anticipated project timelines. Kwapick noted a previous question from a property owner on Country Drive related to access to that commercial property and asked if that has been addressed. The City Engineer confirmed that language has been included to ensure access to those commercial properties. T. Miller introduced the following resolution and moved its adoption: RESOLUTION NO. 2024-1-13 – APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR STREET IMPROVEMENTS The foregoing resolution was duly seconded by D. Miller. Ayes (5). Nays (0). Resolution declared adopted. EASEMENT ACQUISITION FOR COUNTRY DRIVE & SOUTH OWASSO BLVD SIDEWALK PROJECT The City Engineer explained that the City has been working for several months to develop this sidewalk project, which was identified the previous spring as a strong candidate for grant funding. He stated that Ramsey County suggested that the City get the project to shovel ready status in order to have more favorable review during the grant process. He stated that during that process, two easements were identified, and staff began to work with those property owners to obtain those easements. He stated that both property owners have been great to work with, noting that one property owner has already agreed to the easement and the other property owner is working through their corporate process but is amenable given that the City reimburse their legal costs for that review. He asked the Council to approve the resolution as presented. D. Miller asked what would occur if the second property owner were to request additional compensation for the easement outside of the legal fees. The City Engineer commented that if the property owner desires compensation, they would need to go through negotiations and follow the typical City process. He noted that compensation has not been mentioned by the property owner outside of reimbursement of the legal fees. Mayor Fischer introduced the following resolution and moved its adoption:
