MINUTES <br />PLANNING COMMISSION <br />JUNE 11, 2009 <br />listening. F,verson suggested that the increase in problems be documented. <br />He noted that the Montreal Courts apartment complex has the highest <br />crime activity in the City. Everson stated that the risk in granting the <br />variance is that another property owner will be able to provide <br />documentation of an increase in problems under similar conditions. <br />Knudsen recommended approval of the Variance to exceed the maximum <br />fence height allowed in a front yard at 2837/2849 Centerville Road as <br />requested by Afroz Khan with the condition that shrubs, trees, or other <br />greenery be planted on the applicant's side of the fence during this <br />planting season that will, over time, make the fence somewhat invisible, <br />that the applicant document the incidents of crime and vandalism that have <br />occurred on the property, both before and after the loss of trees, which <br />shows the increase in this activity after the trees were lost, and declaring <br />that the hardship is based on the fact that this property is in close <br />proximity to a neighbor with a history of serious crime activity. <br />Motion seconded by Pechmann. <br />Motion carried 6 to 1. Duray voted against. <br />PUD PERMIT- Mary Fasching, 3151 Country Drive, appeared before the Commission <br />3151 COUNTRY and requested that her application for Planned Unit Development Permit <br />DRIVF, - for outdoor storage consisting generally of contractor equipment and <br />FASCHING/ materials be tabled. Fasching reported that she made application for the <br />COSTANZO permit in May and has met with the City Administrator and Code <br />Enforcement Officer to review her site plan a couple of times, most <br />recently last Thursday. Fasching indicated that she just received the Code <br />Enforcement Officer's report two days ago. Fasching also noted the <br />recent changes have been made in the I-1 District relative to outdoor <br />storage which she would like to familiarize herself with. She will also be <br />meeting with her tenants over the weekend and acknowledged that she <br />may have to lose one or two of them. Fasching reported that she would <br />like to work out a plan for the property, review the Code Enforcement <br />Officer's two options in more detail and determine if one will work. <br />It was noted that a 60-Day Waiver form will be needed in order to table <br />action on the PUD request. <br />Knudsen recommended tabling action on the PUD Permit request for 3151 <br />Counhy Drive as requested by Mary Fasching until the July 9, 2009 <br />Planning Commission meeting contingent upon receipt of a 60-Day <br />Waiver Agreement, and declaring that if the Waiver is not received, that <br />
