MINUTES <br />CITY COUNCIL <br />JUNJC 22, 2009 <br />Khan reported that she has lived in her home since 1992 and the trees were <br />in place at that time. These trees provided a screening for the Kha~r <br />property. Khan stated that after her neighbor removed the trees, there was <br />a negative impact on the privacy level at her property. Khan stated that <br />without that privacy, she cannot work in her yard nor open her front <br />windows. Khan indicated that residents fiom the rental property across <br />the street have approached her while she is in the yard, and have lmocked <br />on bedroom windows. Khan reported that her vehicles have been <br />vandalized and her son has been harassed. <br />Keis asked how the fence will prevent these incidents from happening. <br />Khan replied that the fence will provide privacy, noting that she did not <br />have these problems when the trees were in place. Khan stated that the <br />fence will prevent people from seeing her go in and out of her house. Keis <br />noted that the fence runs east and west, thus does not screen the view into <br />the Khan front yard. Khan disagreed, noting the fence screens her yard <br />from the view of vehicles turning to the south from LaBore Road onto <br />Centerville Road. Khan felt that the fence would protect her from people <br />approaching her while she is in the yard and would protect her vehicles as <br />well. Khan also noted that since the security sensors have been installed, <br />she has had no problems on her property. <br />Keis stated that he did not know why either the fence or the trees, given <br />their east/west configuration, would prevent people fiom going onto the <br />Khan property. Khan pointed out that the security sensors keep people off <br />the property and that the fence gives her a sense of privacy. Montour <br />asked if there were no issues when the trees were in place. Khan replied <br />that there were some until she put in motion detectors. Montour asked <br />why the neighbor cut the trees. Blesener pointed out that some were dead <br />and others damaged. <br />Shibaz Khan reported on the instances when he has been approached on <br />his property and reported that with the motion detectors in place, there <br />have been no problems. Shibaz Khan agreed that the fence affords them <br />some privacy. <br />Blesener indicated that it appears that the motion detectors are working <br />rather than the fence. Afroz Khan stated that the fence gives her privacy <br />while she is working in her yard and is what has deterred people from <br />approaching her. Khan pointed out that this is a bad neighborhood and <br />indicated that she is trying to protect herself and son as much as she can. <br />Blesener felt a precedent would be set if this Variance were approved, and <br />indicated that there are other ways to mount motion detectors. He noted <br />that the fence could be 6 '/2 feet from the front of the house to the back. <br />
