MINUTES CITY COUNCIL JiILY 8, 2009 There was no one else present from the general public wishing to comment on this matter. Upon motion by Keis, seconded by Montour, the public hearing was closed. Mr. Montour introduced the following resolution and moved its adoption: RESOL UTION NO. 2009-7-153 - AN ORDINANCE AMENDING HOUSING IMPROVEMENT AREA NO. 2, CANABURY CONDOMINIUMS, PURSUANT TO MN STATUTE 428A.11 THROUGH 428A.2] AND AMENDING THE RESOL UTION ALLOWING PREPAYMENT OF FEES AS RECOMMENDED BY THE CITYADMINISTRATOR The foregoing resolution was duly seconded by Keis. Ayes (5). Nays (0). Resolution declared adopted. McGraw indicated that he would abstain from voting on the HIA #3 ordinance amendment as he is a resident of Pleur Royale. Mr. Montour introduced the following resolution and moved its adoption: RESOL UTION NO. 2009-7-153 - AN ORDINANCE AMENDING HOUSING IMPROVEMENT AREA NO. 3,FLEUR ROYALS, PURSUANT TO MN STATUTE 428A.11 THROUGH 428A.21 AND AMENDING THE RESOLUTIONALLOWING PREPAYMENT OF FEESAS RECOMMENDED BY THE CITYADMINISTRATOR The foregoing resolution was duly seconded by Boss. Ayes (4). Nays (0). Abstains (1) McGraw. Resolution declared adopted. CUP AND Mayor Blesener opened the Public Hearing to consider the request for VARIANCE a Conditional Use Permit for special purpose fence as requested by FOR FENCE - Afroz Khan on property located at 2837 and 2849 Centerville Road. 2837/28x9 Also under consideration is a request for a Variance to exceed maxinmm CENTERVILLF, fence height allowed in a front yard on the same properties. ROAD - KHAN The City Administrator explained that given the concern about the issues of hardship and precedence relative to the Variance, a Conditional Use Pemlit for a special purpose fence is being proposed as an option. The City Administrator reported that staff has met with the property owners involved and reviewed the recommendation outlined in his July 2, 2009
