MINUTES <br />CITY COUNCIL <br />JiILY 8, 2009 <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by Keis, seconded by Montour, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2009-7-153 - AN ORDINANCE AMENDING <br />HOUSING IMPROVEMENT AREA NO. 2, CANABURY <br />CONDOMINIUMS, PURSUANT TO MN STATUTE 428A.11 <br />THROUGH 428A.2] AND AMENDING THE RESOL UTION <br />ALLOWING PREPAYMENT OF FEES AS RECOMMENDED BY <br />THE CITYADMINISTRATOR <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />McGraw indicated that he would abstain from voting on the HIA #3 <br />ordinance amendment as he is a resident of Pleur Royale. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOL UTION NO. 2009-7-153 - AN ORDINANCE AMENDING <br />HOUSING IMPROVEMENT AREA NO. 3,FLEUR ROYALS, <br />PURSUANT TO MN STATUTE 428A.11 THROUGH 428A.21 AND <br />AMENDING THE RESOLUTIONALLOWING PREPAYMENT OF <br />FEESAS RECOMMENDED BY THE CITYADMINISTRATOR <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). <br />Abstains (1) McGraw. Resolution declared adopted. <br />CUP AND Mayor Blesener opened the Public Hearing to consider the request for <br />VARIANCE a Conditional Use Permit for special purpose fence as requested by <br />FOR FENCE - Afroz Khan on property located at 2837 and 2849 Centerville Road. <br />2837/28x9 Also under consideration is a request for a Variance to exceed maxinmm <br />CENTERVILLF, fence height allowed in a front yard on the same properties. <br />ROAD - <br />KHAN The City Administrator explained that given the concern about the issues <br /> of hardship and precedence relative to the Variance, a Conditional Use <br /> Pemlit for a special purpose fence is being proposed as an option. The <br /> City Administrator reported that staff has met with the property owners <br /> involved and reviewed the recommendation outlined in his July 2, 2009 <br />
