MINUTES <br />CITY COUNCIL <br />JULY 8, 2009 <br />Ms. Boss introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2009-7--154 - APPROVING A CONDITIONAL <br />USE PERMIT FOR SPECIAL PURPOSE FENCE FOR THE AFROZ <br />KHAN PROPERTYAT 2837 CENTERVILLE ROAD SUBJECT TO <br />THE CONDITIONS OUTLINED IN THE CITYADMINISTRATOR'S <br />REPORT DATED JULY 2, 2009, THAT THE FENCE HEIGHT BE <br />ADJUSTED TO A MAXIMUM OF 6 % FEET, AND THAT MRS. <br />KHAN ENTER INTO AN AGREEMENT WITH THE CITY <br />ALLOWING THE FENCE TO BE ABATED SHOULD IT NOT BE <br />REMOVED WITHIN FIVE YEARS OR WHEN SCREENING <br />PLANTINGS REACH SIX FEET IN HEIGHT, WHICHEVER IS <br />SOONER <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (1) Blesener. Resolution declared adopted. <br />CULVER'S Council reviewed the City Engineer's report dated July 8, 2009 relative <br />STORM WATER to the treatment of storm water on the Culver's site located at the <br />INFILTRATION southeast corner of Rice Street and Market Place Drive. It was noted that <br />RATE both the Watershed District's and the City's storm water treatment <br />regulations adopted this spring require a 48-hour draw down time for <br />subsurface infiltration. In conducting its review of the Culver's site, the <br />Watershed used some outdated review sheets and approved a 72-hour <br />drawn down time. The impact of the 48-hour versus 72-hour draw down <br />time is that the first one inch of rainfall from the site would be fully <br />infiltrated and treated every two days instead of every three days. The <br />City Administrator noted that given the existence of the Market Place <br />Pond in the storm water treatment area, this is not a major issue. The City <br />Administrator noted that the City Engineer is recommending approval of <br />the 72-hour drawn down time as was approved by the Watershed District. <br />Keis asked the impact on Culver's if the City does not approve the request. <br />The Administrator indicated that Culver's would have to install a larger <br />storm water containment system. Montour asked if this is considered a <br />variance from the City's current policies. "The Administrator indicated <br />that there have been developments in the City that have complied with <br />these new standards. He noted that the Watershed is willing to allow the <br />72-hour drawn down standard for Culvers. The Administrator pointed out <br />that the area is unique given the existence of the Market Place Pond which <br />serves the larger area. <br />Keis stated that he did not support a variance from the City's newly <br />adopted standards. He can appreciated that the Watershed made an error <br />in processing their permit, but felt the City should require compliance with <br />
