FREDERICK P. MEMMER
SELDON H. CASWELL
CLAYTON PARKS. JR.
BRUCE L. BECK
E
July 7, 1976
Mr.Joseph Chlebeck
City Clerk - City of Little Canada
515 Little Canada Road
Little Canada, Minnesota 55117
Dear Joe:
c/ EmmE2, eaiwall & (Y-Da4i
ATTORNEYS AT LAW
1S90 WHITE BEAR AVE.. ST. PAUL. MINNESOTA 86106
PHONE 774-6791
RE: City of Little Canada vs.
Howard L. Mostad, et al
This letter is to remind you that July 22nd, 1976, is the
last day of the 90 day period for the report of the Commissioners in
the above entitled condemnation proceeding. The Commissioners hearing
has not yet been held but will probably be completed within 10 days and
a report will follow immediately. Any time on or after July 23rd, 1976
will be permissible for the`yto enter the property and commence
the construction of the pond. It is my suggestion that arrangements
be made with the may ahead of time so thac the construction can be
begun as soon after the 23rd as possible.
There will undoubtedly be some planning necessary prior to the
construction and perhaps some discussion with the land owners and his
attorney relative to the disposition of the soil to be removed during
excavation. You might recall that Mr. Moetad requested that any soil
to be removed would remain on the site for his use on the adjacent
property and we indicated to him that we had no objection to such
disposition. If these matters are discussed prior to the 90th day of
the waiting period, it might save some time in getting the construction
under way.
CPJr:po
cc: Mr. John E.
