E/1 <br />CONTRACT NO. 77-1' <br />o a& <br />OR <br />THIS AGREEMENT made this 12th day of May, 1977, by and between BITUMINOUS <br />ROADWAYS, INC., hereinafter called the Contractor��and the CITY OF LITTLE <br />CANADA, MINNESOTA, Hereinafter called the City. <br />WITNESSETH: That the Contractor and the City for the consideration stated <br />herein, mutually agree as follows: <br />ARTICLE 1. Statement of Work. The Contractor shall furnish all labor, <br />material, equipment and services, and perform and complete all work in <br />strict accordance with the intent of, and the requirements established <br />by the <br />SPECIFICATIONS FOR <br />Tennis Court Construction <br />And Addenda thereto numbered (none) 0, dated &. and <br />the Drawings referred to therein, which said Specifications, Addenda and <br />Drawings are incorporated herein by reference and made a part hereof. <br />ARTICLE 2. Time of Completion. The Contractor shall commence work <br />under this contract on a date specified in the Written Notice to Proceed <br />to be issued by the City and shall complete all work thereunder within <br />the specified time period. See Special Conditions. <br />ARTICLE 3. The Contract Price. The City shall pay the Contractor for <br />the performance of the Contract, in current funds, subject to additions <br />or deductions as provided in the Contract Documents, the sum of nineteen <br />thousand nineteen and no/100 dollars ($19,019.00). <br />ARTICLE 4. Contract Documents. Contract Documents shall consist of the <br />following component parts: <br />a. This Instrument <br />b. Bid <br />c. Instructions to Bidders <br />d. Special Conditions <br />e. Technical Specifications <br />f. Drawings <br />This instrument together with the other documents enumerated in this <br />Article 4, which said other documents are as fully a part of the Contract <br />as if hereto attached or herein repeated, for the Contract. In the event <br />that any provision in any component part of this Contract conflicts with <br />any provision of any other component part, the provision of the component <br />part first enumerated in this Article 4 shall govern, except as otherwise <br />specifically stated.
