ORDINANCE NO. 141 <br />AN ORDINANCE AMENDING THE LIT= CANADA <br />CODE BY ADDING A NEW CHAPTER 2101. PARK <br />AVAILABILITY CHARGES. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. <br />That the Municipal Code of Little Canada is hereby amended by adding <br />a new Chapter 2101. Park Availability Charges. to read as follows: <br />"2101. PARK AVAILABILITY CHARGES, <br />2101.010. PURPOSE. This ordinance is enacted to provide for orderly, <br />economic and safe development of land and urban services and facilities, and to <br />promote the public health, safety and general welfare of the inhabitants of the <br />City of Little Canada. <br />2101.020. LAND DEDICATION FOR PUBLIC USE. In all subdivisions to be <br />developed for residential, commercial, industrial or other uses or as a planned <br />development which includes residential, commercial and industrial uses, or any <br />combination thereof, where the City Council deems it appropriate, a reasonable <br />portion of each proposed subdivision shall be dedicated to the public for public <br />use as parks, playgrounds, public open space or storm water holding pond areas, <br />or, at the option of the City, the person or firm proposing the subdivision shall <br />donate to the City an amount in cash equivalent to the fair market value of the <br />same land which otherwise would have been dedicated. The City Council, in <br />determining the reasonable portion to be dedicated to the public may take into <br />consideration the open space, park, recreation or common areas and facilities <br />which the developer has provided for the exclusive use of the residents of the <br />subdivision. The portion of the total area which becomes dedicated pursuant to <br />these provisions shall be in addition to that land dedicated for streets, alleys, <br />easements and other public ways. No areas may be so dedicated for public use <br />without first having been approved by the City Council as suitable for the public <br />purposes enunciated in Section 2101.010 herein. <br />1. If the City Council, at its option, requires the developer to dedicate <br />land, a maximum of 107 of the total area to be subdivided shall be dedicated for <br />public use as parks, playgrounds, open space or storm water holding pond areas. <br />2. If the City Council, at its option, requires the developer to donate <br />cash in lieu'of land the following criteria shall be applied: <br />(a) The developer shall donate that dollar value of the tract <br />to be subdivided for residential use which corresponds to <br />S <br />Page 26 CLERK'S EXHIBIT NO 1240 <br />MEETING_ _ <br />9 14-7? <br />
