BOARD OF WATER COMMISSIONERS NINTH RIDER TO AGREEMENT �0% THIS AGREEMENT, Made this day of , 19789 by and between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL, hereinafter called the Board, and the CITY OF LITTLE CANADA, County of Ramsey, Minnesota, hereinafter called the City, being the Ninth Rider to that certain Agreement made by and between said Board and said City the 13th day of July, 1966, and by this reference incorporated herein and made part hereof with the same intent, purpose and effect as if said Agreement were set forth herein, verbatim. WITNESSETH: WHEREAS, The Board is fee owner of a 185 foot wide right-of-way across the Southwest One -Quarter (SWk) of the Southwest One -Quarter (SWk) of Section Eighteen (18), Township 29 North, Range 22 West, County of Ramsey; and WHEREAS, The City desires permission to enter upon certain portions of said —4emises and to therein, thereon and thereunder install, and operate a 16-inch water L./ main; and WHEREAS, The Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board, NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and agree- ments of the parties hereto, that said Board hereby grants to said City the permission to install and operate a 16-inch water main along and across the Boardts right-of-way, as outlined in red color and location as shown on attached drawing marked Exhibit "A". BE IT FURTHER AGREED, That paragraph 42 of the original Agreement dated 13 day of July, 1966, pertaining to "Minimum Standards for Public Waterworks and Public Sewers" be rescinded for this project and that the 16-inch water main and appurtenances in- stallation shall be in accordance with the Milner W. Carley & Associates Plan and Spec- ification for Water Main Improvement 77-5, 6 Sheet 7 City of Little Canada, dated lv�ruary 1, 1978, of said Project, which plan and specifications have been approved by the Board, and marked with Water Utility Plan a Number N-6475, and said specifications C1 �'s'exhib,tt n ,, 130 Meet:LA9-44 4-78
