<br />12 <br /> <br />34. 1033. The Buyer herein acknowledges that the Seller wishes to take advantage of the <br />provisions\IRC Section 1033. The Buyer will cooperate in providing those documents to <br />establish that an eminent domain action would be commenced if necessary. <br /> <br />35. Lease Back. Buyer will agree to lease back to Seller the building presently located on the <br />Property. Use of the leased premises should be limited to storage of Seller’s personal <br />property. The lease shall commence immediately upon closing and terminate at midnight <br />December 31, 2030. No rent shall be charged Seller during the term of the lease however <br />Seller shall indemnify and hold Buyer harmless from any and all damage to personal <br />property stored according to this lease as well as any personal injury which results from <br />the Sellers exercise of its lease hold rights. Seller shall provide Buyer with a general <br />liability policy covering both personal injury and property damage. Coverage shall be no <br />less than $1,000,000. The insurance policy shall name the Buyer as an additional named <br />insured.
