All of the Grading aizd Drainage <br />Improvements shall be approved by the City and shall be consistent with the Final Plat and the <br />Grading, 1>oi~d Planting and 13rosion Contr.~l Plan (Gl) dated January 26, 2009 and Post- <br />Development Drainage Area Plan (DA1) dated January 26, 2009, subject to any revisions <br />required by the City Engineer wtth the imdetstandin~ th<it_oi~l~lse 1 is beii~ coi~5tructcd <br />under the terms of this agreement. A copy of said plans are attached hereto and incorporated <br />herein as Exhibit C-1 and C-2 respectively. Developer or their agents or assigns, shall comply with all provisions of the Storm <br />Water Pollution Prevention Plan (SWPPP) includiug but not limited to keeping the public streets <br />clear of any soil, earth or debris resulting from work done by Developer or his agents or assigns. <br />Any such materials must be promptly removed and in no event shall they be present more than <br />24 hours after placement. Failure to comply with this provision will result in the City <br />undertaking this work with costs to be reimbursed by Developer pursuant to Paragraphs #'s 11 & <br />12. <br />17&. The Developer shall cause to be performed to the City Engineer's satisfaction all <br />finish grading, on each lot of the plat and shall maintain said grading until a Certificate of <br />Occupancy is issued for each respective lot within the Plat. During this period the Developer <br />shall prevent erosion by wind and water to the pursuant to a~i tl~ approved Storm Water <br />Pollution Prevention Plan (SWPPP) and to the City Engineer's satisfaction.
