<br /> <br />826.100 VIOLATIONS, SUSPENSION, REVOCATION, FINES. <br /> <br />(a) Misdemeanor prosecution. Nothing in this section shall prohibit the city from seeking <br />prosecution as a misdemeanor for any alleged violation of this division. <br />(b) Any licensee found to have violated this ordinance, or whose employee violated this <br />ordinance, will be subject to the following administrative fines, suspensions or <br />revocation: <br /> <br />1. The first such violation shall subject the licensee to the payment of an <br />administrative fine of $300 plus an additional compliance check; <br />2. The second violation within 36 months shall subject the licensee to the <br />payment of an administrative fine of $600 plus an additional compliance <br />check; <br />3. The third violation within 36 months shall subject the licensee to the payment <br />of an administrative fine of $1,000 and to a minimum seven (7) business-day <br />suspension of the license; <br />4. The fourth violation within 36 months shall subject the licensee to the <br />payment of an administrative fine of $1,500 and to a minimum fifteen (15) <br />business-day suspension of the license; <br />5. The fifth violation within 36 months shall subject the licensee to the payment <br />of an administrative fine of $2,000 and to a minimum thirty (30) business-day <br />suspension of the license. <br />6. The sixth violation within 36 months shall be cause for revocation of the <br />license for up to one year. <br /> <br /> The imposition of an administrative fine and a suspension of license or to a license <br />revocation pursuant to this section shall be preceded by a hearing before the City <br />Council. <br /> <br />826.110 BILLBOARDS. No billboard, as defined in this chapter, shall promote the sale or use <br />of cannabinoid products. <br /> <br />826.120 SEVERABILITY. If any section or provision of this ordinance is held invalid, such <br />invalidity will not affect other sections or provisions that can be given force and effect without the <br />invalidated section or provision. <br /> <br /> <br />SECTION 2. REPEAL OF CONFLICTING ORDINANCES. That all ordinances or parts of <br />ordinances in conflict herewith are hereby appealed. <br /> <br /> <br />SECTION 3. SEVERABILITY CLAUSE. Every section, provision, and part of this Ordinance is <br />declared severable from every other section, provision, and part. If any section, provision, or part of this <br />Ordinance is held to be invalid by a court of competent jurisdiction, such judgment shall not invalidate <br />any other section, provision, or part of this Ordinance. <br /> <br />
