MINUTES <br />City Counci1 <br />March 11, 19II7 <br />Mr. forsberg stated that he did not like the fact that St. Jude's was <br />building without a PUD Flgreement. <br />Councilman Fahey statecl that he was not prepared to accept any amount <br />less than what the City had proposed unless there was the cledication <br />of some property for a trai1 system for public use or an increase <br />in the later payment. <br />Mrs. Nardini questioned if th~ City wnuld be unfair to Yorkton Development <br />by accepting the lesser park charge proposed by St. Jude's. <br />Flttorney Parks stated that the City would make an enemy out of St. Jude's <br />if the matter went to court. Fahey felt the City should not back down, <br />and any court action would also cost St. Jude's money. <br />Fahey also fe7t that it would be unfair to other deve1opers in the City <br />to accept St. Jude's proposal. <br />The City Clerk stated that the final approval for revenue bonds has not <br />been granted by the C9ty for St. Jude's. <br />Mr. Hanson introduced the following reso1ution and moved its adoption: <br />RESOLUTION N0. 81-3-122 - INSTRUCTI~lG THE CITY FlTTORNEY TO <br />NEGOTIA7[ THE PUD FlGREEMENT 6JITF1 ST. JUDE'S WOULD BE <br />DESIRED AS REMAINING IN Fl PERPETUA.L STATE FlS DESIGNED <br />The foregoing resolution was du7y seconded by Mr. Forsberg. <br />Ayes (2) Flanson, Forsberg. <br />Nayes (3) fahey, Nardini, Scalze. <br />Resolution denied. <br />This resolution appears in Resolution ~ook ~lo. 7, Page 81. <br />Councilman Fahe,y stated that the City has a right to 9nform St. Jude's <br />that their offer is unacceptable. St. Jude's knew that the PUD Flgreement <br />would include park charges. <br />Attorney Parks stated that the figures the Council has set on were pulled <br />out of the air and there might be an error in these figures. Parks also <br />stated that in negotiations there must be some give and take. <br />Mr. Fahey stated that the City has been fair to St. Jude's. <br />Attorney Parks commented that he hoped to make some progress w~th St. Jude's. <br />Page -19- <br />
