Chapter 916: Signs <br /> <br /> Page 916-7 <br />D. No signs other than public signs shall be erected or temporarily placed within any street <br />right-of-way or upon any public lands or easements or rights-of-way. <br />E. No sign or sign structure shall protrude over public right-of-way, except wall signs <br />(maximum protrusion – 18 inches). All signs located over public right-of-way or over <br />any public or private access route (sidewalks, etc.) shall be located a minimum of 10 <br />feet above surface grade. <br />F. Advertising signs, excluding billboards, may not be illuminated between the hours of <br />midnight and 6:00 a.m. <br />G. All height restrictions on signs shall include the height of the sign structure and be <br />measured from lot grade. <br />H. Any sign that no longer advertises or identifies an active business, service, or product <br />shall have any identification covered, removed, or modified to eliminate reference to <br />the inactive use by the owner, agent, or person having beneficial use and/or control of <br />the building or structure where the sign is located. This modification must be <br />completed within ten (10) days after receiving written notice from the Zoning <br />Administrator. Removal of the sign structure itself is not required. <br />I. Window Signs (Commercial and Industrial Districts Only). <br />1. Window signs shall be permitted in addition to other permitted signage, provided <br />that such signage covers no more than 20 percent of the window area for any <br />business entity. <br />2. Window signs with areas in excess of that permitted are subject to temporary <br />signage requirements and standards found in section 916.080 of this Chapter. <br /> <br />916.050 Dynamic Display Signs <br />A. Regulations for Dynamic Display Signs. These regulations shall apply to all proposed <br />dynamic signage in the City, whether new or existing, on-premise or off-premise, <br />conforming or non-conforming at the time of adoption of this Chapter. Dynamic display <br />billboards are additionally subject to the requirements of Section 916.090. The following <br />performance standards have been established to minimize the public safety concerns <br />regarding dynamic display signs. <br />1. No dynamic sign shall have lettering smaller than the Letter Height listed in Table <br />916-1. <br />Table 916-1 <br />Dynamic Sign Regulations <br /> I-694, I-35, TH 36 Other Roadways <br />Letter Height Twelve (12) inches Six (6) inches <br /> <br />2. Dynamic signs shall have messages and static displays that change instantaneously, <br />and include a minimum eight-second hold time on images. <br />3. Dynamic signs shall not be permitted in any residential zoning district and shall <br />have a buffer of 50 feet from any residentially zoned property. All dynamic signs <br />shall be arranged such that light is deflected away from any adjoining residential <br />area. <br />4. Dynamic signs shall be no brighter than other illuminated signs in the same district <br />and not to exceed a maximum brightness of 0.3-foot candles above ambient light <br />with automatic dimmer control.
