MINUTES <br />City Council <br />Sept. 9, 1987 <br />Street Collova stated that he agreed with Mr. Kehn's comments, however, pointed <br />Assessment out that if the property is sold a new owner could come in with a <br />Policy proposal to divide the property which the Council could not deny unless <br />(Cont.l there were deed restrictions. <br />Kehn felt the precedent should stand. <br />Fahey suggested that perhaps if there are not deed restrictions in <br />existence, the property owners would be willing to agree to them at <br />this time. <br />Kehn replied that he would agree to deed restrictions. <br />Fahey stated that the City could agree not to assess the splitable lot, <br />if the property owners agreed never to split the property. <br />However, Fahey pointed out that property owners in other parts of <br />the City might request the same thing. Fahey then commented that <br />the Roy Wilson Addition is different due to the past precedent that <br />has been set for the area. <br />Kehn reported that he was never informed of the improvement hearing <br />for Plorrison, and was only advised of the assessment hearing. <br />The City Attorney stated that it was his opinion that Mr. Kehn would <br />have a splitable lot if there was enough frontage and square footage <br />to meet Code requirements. <br />Kehn pointed out that Roy Wilson sold the property as 1/2 acre lots. <br />The City Attorney noted the letter from William McGraw stating that <br />there is nothing of record restricting these parcels to 1/2 acre lots. <br />The City Attorney also noted that the property is Torrens property <br />and there are very strict regulations as to what can be filed against <br />Torrens property. The Attorney stated that he would have to draft <br />a document and present it to the Examiner of Titles to see if it <br />could be filed against the properties in question. <br />Fahey noted that lot splits have been denied for the Diana Lane area <br />due to the large lots that were platted along that street. <br />Scalze noted that there has been no formal presentation for a lot split, <br />but the Council is aware it could happen and must plan for the future. <br />Scalze noted that one house in the area is for sale right now. <br />Fahey stated that he would agreed to the precedent request, if the <br />City is able to file restrictions against the properties stating <br />that they could not be split. Fahey suggested that the City Attorney <br />research this possibility. <br />Kehn asked the amount of time he had to file an appeal of his <br />assessment. <br />Page -5- <br />
