4. Cannabis Retailer. Any person, partnership, firm, corporation, or association, foreign or domestic, selling cannabis product to a consumer and not for the purpose of resale in any form. 5. Office of Cannabis Management (OCM). Minnesota Office of Cannabis Management, referred to as “OCM” in this ordinance. 6. Preliminary License Approval. OCM pre-approval for a cannabis business license for applicants who qualify under Minn. Stat. 342.17. 7. Retail Registration. An approved registration issued by the City of Little Canada to a state- licensed cannabis retail business. 8. School. A public school as defined under Minn. Stat. 120A.05 or a nonpublic school that must meet the reporting requirements under Minn. Stat. 120A.24. 9. State License. An approved license issued by the State of Minnesota’s Office of Cannabis Management to a cannabis retail business. B. General Provisions 1. Co-location with Residential. Cannabis uses, either principal or accessory, shall be prohibited from locating in any building which is also utilized for residential purposes. 2. Adjacent to Residential. The following cannabis uses, either principal or accessory, shall be prohibited from locating on any property that is adjacent to a property residentially zoned or which has a residential user: i. Cannabis Cultivation ii. Cannabis Manufacturing, Processing, Extraction iii. Cannabis Wholesale 3. Compliance. All Cannabis uses are subject to the regulations and standards of Chapter 827 of the City of Little Canada Municipal Code. C. Buffer Requirement. The City of Little Canda prohibits local registration of a new cannabis business on a premises with a property line within 500 feet of the property line of any of the following: 1. School 2. An attraction within a public park that is regularly used by minors, including a playground or athletic field. D. Outdoor Cultivation. Any cannabis business that includes outdoor cultivation, such as cannabis cultivator, microbusiness, or mezzobusiness must comply with the following: 1. A minimum of twenty (20) contiguous acres is required for the portion of the property that will be dedicated to cultivation. 2. The cannabis plants must be setback a minimum of three hundred feet (300’) from the property lines. 3. There must be fencing of six feet (6’) around the perimeter and a landscaped or screened buffer is required to be placed outside of the fence but within the setback area, which may consist of a berm, trees, or combination thereof. 4. The cannabis plants cannot be visible from any public right of way.
