4. Cannabis Retailer. Any person, partnership, firm, corporation, or association, foreign or <br />domestic, selling cannabis product to a consumer and not for the purpose of resale in any form. <br />5. Office of Cannabis Management (OCM). Minnesota Office of Cannabis Management, referred <br />to as “OCM” in this ordinance. <br />6. Preliminary License Approval. OCM pre-approval for a cannabis business license for <br />applicants who qualify under Minn. Stat. 342.17. <br />7. Retail Registration. An approved registration issued by the City of Little Canada to a state- <br />licensed cannabis retail business. <br />8. School. A public school as defined under Minn. Stat. 120A.05 or a nonpublic school that must <br />meet the reporting requirements under Minn. Stat. 120A.24. <br />9. State License. An approved license issued by the State of Minnesota’s Office of Cannabis <br />Management to a cannabis retail business. <br />B. General Provisions <br />1. Co-location with Residential. Cannabis uses, either principal or accessory, shall be prohibited <br />from locating in any building which is also utilized for residential purposes. <br />2. Adjacent to Residential. The following cannabis uses, either principal or accessory, shall be <br />prohibited from locating on any property that is adjacent to a property residentially zoned or <br />which has a residential user: <br />i. Cannabis Cultivation <br />ii. Cannabis Manufacturing, Processing, Extraction <br />iii. Cannabis Wholesale <br />3. Compliance. All Cannabis uses are subject to the regulations and standards of Chapter 827 of the <br />City of Little Canada Municipal Code. <br />C. Buffer Requirement. The City of Little Canda prohibits local registration of a new cannabis <br />business on a premises with a property line within 500 feet of the property line of any of the <br />following: <br />1. School <br />2. An attraction within a public park that is regularly used by minors, including a playground or <br />athletic field. <br />D. Outdoor Cultivation. Any cannabis business that includes outdoor cultivation, such as cannabis <br />cultivator, microbusiness, or mezzobusiness must comply with the following: <br />1. A minimum of twenty (20) contiguous acres is required for the portion of the property that will be <br />dedicated to cultivation. <br />2. The cannabis plants must be setback a minimum of three hundred feet (300’) from the property <br />lines. <br />3. There must be fencing of six feet (6’) around the perimeter and a landscaped or screened buffer is <br />required to be placed outside of the fence but within the setback area, which may consist of a <br />berm, trees, or combination thereof. <br />4. The cannabis plants cannot be visible from any public right of way.
