MINUTES <br />CITY COUNCIL <br />September 27, 1989 <br />possible. xowever, Bowman reported that he has <br />researched the issue of the SO/20 assessment policy and <br />has learned that most other surrounding cities are <br />assessing a smaller percentage than the 80% the City is <br />proposing to assess. Bowman reported that it is the <br />property owners' position that a variance from the <br />80/20 policy is warranted in this instance since the <br />situation is unique. Bowman referred to Payne Avenue <br />as a lemon. Bowman pointed out that when the street <br />was first improved, the cost of the improvement was <br />assessed at 100%. Bowman questioned why the road was <br />ever conetructed if there were concerns for the high <br />water table in the area, and reported that property <br />owners along Payne Avenue are also having problems with <br />their foundations and driveways due to the water table. <br />Bowman reported that he checked Council minutes back to <br />1975 and there was concern expressed about the water <br />table and subsoils back to that date. Bowman did not <br />feel that the City took a strong enough roll in the <br />project with regard to checking soil compaction, taking <br />appropriate tests, etc. Bowman stated that for the <br />concerns that were expressed, there should have been <br />someone on hand making sure that soil compaction was <br />done properly. <br />Bowman also reported that reference was made that the <br />qeo-technic fabric was not available in 1979, however, <br />Bowman reported that it was used as early as 1978 in <br />Edina. <br />Bowman felt that because of the unique situation, <br />unique measures should have been taken in the original <br />construction of Payne Avenue. <br />Bowman reported that as early as 1981 there was already <br />a major patch repair done on Payne Avenue. Therefore, <br />there were already problems evident as little as two <br />years after the street was constructed. <br />Bowman asked if the City had in place a street <br />maintenance program. <br />Bowman also reported that he has been informed that the <br />average life of a road is about 18 years, but that life <br />can be extended to 40 years if proper road maintenance <br />is performed. <br />Page 14 <br />
