MINUTES <br />CITY COUNCIL <br />September 27, 1989 <br />installed, that drain tile would not be necessary. <br />Lunders pointed out that the residents of the area have <br />swales in their backyards which are supposed to direct <br />run-off out of the area. Lunders also pointed out that <br />hauling by 20-ton weight vehicles was permitted on a <br />5-ton road. <br />Scalze reported that the 20-ton vehicles were not <br />permitted. Those vehicles were in violation of City <br />Ordinances and were tagged. <br />Lunders pointed out that the contractors who made these <br />violations, were contractors to whom the City issued <br />permits. <br />Fahey stated that that issue could be debated either <br />way, pointing out that the City has acknowledged that <br />some of the damage to Payne Avenue was caused by <br />overweight hauling. <br />Blesener also pointed out that there are residents on <br />Payne Avenue who also benefited by this hauling. <br />Lunders suggested that if the road had been sealcoated, <br />this would have helped the situation. <br />Blesener stated that it is the City's policy to reseal <br />a street 1 to 2 years after it is improved. However, <br />the street was not resealed in recent years because of <br />the debate about its reconstruction. <br />Lunders felt that the cost of the overlay should come <br />from surplus TIF funds, and should not be assessed. <br />Blesener disagreed, pointing out that the upgrade to a <br />7-ton street was a cost never borne by the residents, <br />and Blesener felt this portion of the improvement <br />should be assessed 800. <br />Craig Bernsten, 3005 Payne Avenue, asked about the <br />grinding that is proposed. <br />The City Engineer reported that a portion of the street <br />will be ground at the curb line so that when the 2-inch <br />overlay is installed, it will meet the curb. <br />Lunders felt that the cost of maintenance that Payne <br />Avenue never received from the City should be <br />subtracted from the cost to be assessed against the <br />property owners. <br />Page 23 <br />
