Except as otherwise provided in this Paragraph (g), <br />the Grantee must repay to the Council all loan repayment amounts the Grantee receives from <br />the Project Owner. The Grantee shall not be obligated to repay the grant funds to the Council <br />except to the extent the Project Owner repays its loan to the Grantee, provided the Grantee <br />has exercised the reasonable degree of diligence and used administrative and legal remedies <br />a reasonable and prudent housing finance agency would use to obtain payment on a loan, <br />taking into consideration (if applicable) the subordinated nature of the loan. <br />As an alternative to such loan proceeds recovery, the Grantee may elect Redeployment of <br />Repaid Grant Funds. If the Grantee elects Redeployment of Repaid Grant Funds, the Grantee <br />shall report such Redeployment of Repaid Grant Funds in its next annual Housing Policy and <br />Production Survey. Upon the Council’s review of any Redeployment of Repaid Grant Funds <br />identified in the Grantee’s Housing Policy or Production Survey or otherwise, the Council <br />reserves the right to request return of such funds if, after review, the Council determines such <br />Redeployment of Repaid Grants Funds does not comply with the Livable Communities Act <br />program requirements, or affordable and life-cycle housing goals. Upon the Council’s request, <br />the Grantee shall promptly return the Repaid Grant Funds. <br />(h) If the Grantee earns any interest or other income from its loan agreement with the Project Owner, <br />the Grantee must repay to the Council all interest or other income the Grantee receives from <br />the Project Owner. Alternatively, the Grantee may elect redeployment of interest or other <br />income received from the Project Owner. If the Grantee elects redeployment of such interest <br />or other income so received, the Grantee shall report such redeployment in its next annual <br />Housing Policy and Production Survey. Upon the Council’s review of any such redeployment <br />identified in the Grantee’s Housing Policy or Production Survey or otherwise, the Council <br />reserves the right to request return of such interest or other funds if, after review, the Council <br />determines such redeployment of does not comply with the Livable Communities Act program <br />requirements, or affordable and life-cycle housing goals. Upon the Council’s request, the <br />Grantee shall promptly return the interest or other income received from the Project Owner. <br />The Grantee is not obligated to earn any interest or other income from its loan agreement with <br />the Project Owner, except to the extent required by any applicable law. <br />2.06. Revolving or Deferred Loans. If consistent with the application and the Project summary or <br />if requested in writing by the Grantee, the Grantee may use the grant funds to make deferred loans <br />(loans made without interest or periodic payments), revolving loans (loans made with interest and <br />periodic payments), otherwise make the grant funds available on a “revolving” basis for the purposes <br />of implementing the Project activities described or identified in Attachments A and B. <br />As an alternative to such loan proceeds recovery for revolving loans, the Grantee may elect <br />Redeployment of Repaid Grant Funds. If the Grantee elects Redeployment of Repaid Grant Funds, <br />the Grantee shall report such Redeployment of Repaid Grant Funds in its next annual Housing Policy <br />and Production Survey. Upon the Council’s review of any Redeployment of Repaid Grant Funds <br />identified in the Grantee’s Housing Policy or Production Survey or otherwise, the Council reserves <br />the right to request return of such funds if, after review, the Council determines such Redeployment <br />of Repaid Grants Funds does not comply with the Livable Communities Act program requirements, <br />or affordable and life-cycle housing goals. Upon the Council’s request, the Grantee shall promptly <br />return the Repaid Grant Funds.
