MINUTES <br />CITY COUNCIL <br />December 13, 1989 <br />Mr. Pantzar pointed out that the documents had already <br />been provided. Pantzar expressed concern that there <br />was not more involvement on the part of the City's <br />Building Inspector when the wall was being <br />constructed. Pantzar also pointed out the City issued <br />the occupancy permits for the townhomes. <br />Fahey again stated that the City Attorney will review <br />the situation and give the Council an opinion. <br />Pantzer pointed out that the City was the inspector on <br />the project and it was the City's responsibility to <br />make sure the project was developed properly. <br />The City Attorney reported that he would like to <br />examine the documents that have been referenced. The <br />Attorney stated that if the development agreement <br />addressed the retaining wall, then wall would be the <br />City's reponsibility. <br />Mr. McNabb stated that he would reprovide the documents <br />that he previously submitted. <br />Fahey suggested that the original minutes on the <br />townhome development be researched to determine if <br />there was any reference to the retaining wall. These <br />minutes should be provided to Mr. McNabb and the City <br />Attorney. <br />CENTRE PLACE Fahey reported that it appears that Mr. Nick Boosalis <br />has done substantially what the City had required with <br />regard to screening of his retail building on Rice <br />Street. <br />Tim Townsley, Iona Lane resident, appeared before the <br />Council and reported that the retaining wall that has <br />been constructed is not the height that the developer <br />had indicated. Townsley also reported that there are <br />less trees than were agreed to. <br />Fahey reported that City records indicate that the <br />developer agreed to plant 8 trees along the fence. <br />Townsley disagreed and indicated that the number of <br />trees was to be 16. Townsley was also concerned that <br />the trees are not the height that was promised. <br />Townsley stated that the developer was to leave an area <br />of 30 feet on the north side of the fence untouched, <br />Page 9 <br />
