MINUTES <br />CITY COUNCIL <br />January 24, 1990 <br />At this point in the meeting the Economic Development <br />Authority adjourned, and the meeting continued solely <br />as a regular City Council meeting. <br />VALENTO Fahey opened the public hearing on the Valento variance <br />VARIANCE appeal. Fahey reported that in July of 1989, Mr. <br />Valento made application for a front yard setback <br />variance for Lots 2, 3, and 4, Block 3, Thunder Bay <br />Estates. The Planning Commission recommended denial of <br />that variance request, and the Council also acted to <br />deny the variance. Mr. Valento is now appealing the <br />Council's action, and in cases of appeal, the City <br />Council acts as the Board of Adjustments. <br />Fahey reported that the Planning Commission considered <br />the appeal at its January 11, 1990 Council meeting and <br />recommended passing on the matter to the City Council <br />with no recommendation. <br />Mr. Don Valento appeared before the Council on his <br />variance request. Valento reviewed past history of the <br />area, pointing out that when the City required that <br />Valento Lane be extended to LaBOre Road, the road was <br />shifted over to the east and was located 22 feet from <br />the home he owned on the east corner of Valento Lane <br />and LaBore Road. Valento pointed out that he did not <br />ask for a front yard setback variance at the time the <br />plat was approved, but did not realize at the time the <br />size homes that would be built in the area. <br />Valento pointed out that his lots are 100 feet wide by <br />100 feet deep, and the shallow depth of the lots is <br />difficult to work with. Valento reported that he is <br />having difficulty selling these lots for this reason, <br />and pointed out that the lots are the only ones in the <br />area that have not been built on. Valento also pointed <br />out that there is a very large tree on Lot 2, 7 1/2 <br />feet in diameter, which he would like saved, if <br />possible. <br />Valento pointed out that the home on Lot 1 is setback <br />22 feet from the curbline, and Code would require the <br />homes on Lots 2, 3, and 4 to be setback 40 feet from <br />the curbline. That is, 30 feet of setback from the <br />right-of-way line, plus the 10 foot right-of-way to the <br />curbline. Valento pointed out that without a variance <br />the homes on Lots 2, 3, and 4 would be set 18 feet <br />further back than the house on Lot 1. Valento felt <br />that a slight variance would improve the aesthetics of <br />the area. <br />Page 5 <br />
