MINUTES <br />CITY COUNCIL <br />NOVEMBER 28, 1990 <br />Mr. Fahey introduced the following resolution and moved <br />its adoption: <br />RESOLUTION NO. 90-11-523 - REAFFIRMING APPROVAL OF THE <br />PRELIMINARY PLAT OF COSTA ESTATES WITH COSTA LANE <br />RUNNING NORTH TO ALLEN AVENUE AND INSTRUCTING THE CITY <br />ATTORNEY AND CITY ADMINISTRATOR TO DRAW UP THE <br />APPROPRIATE DEVELOPMENT AGREEMENT STATING THAT THE CITY <br />WILL INITIATE CONDEMNATION ACTION TO EFFECTUATE COSTA <br />LANE GOING TO THE NORTH AT SUCH TIME AS THE DEVELOPER <br />REQUESTS THE ROAD BE CONSTRUCTED WITH COSTS OF <br />CONDEMNATION TO BE ASSESSED EQUALLY AGAINST ALL THE <br />BENEFITTING LOTS ABUTTING COSTA LANE AND WITH THE <br />FURTHER UNDERSTANDING THAT SHOULD THE COST OF <br />ASSESSMENTS EXCEED BENEFITS RECEIVED, THE DEVELOPERS <br />AGREE TO ACCEPT THE ASSESSMENT AMOUNT OVER BENEFIT AND <br />WAIVE THEIR RIGHT TO APPEAL AS A CONDITION OF ROADWAY <br />IMPROVEMENT <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (3) Fahey, LaValle, Collova, Blesener. <br />Nays (1) Blesener. <br />Resolution declared adopted. <br />Blesener stated that he opposes the resolution since he <br />believes the Plessel house would be too close to the <br />road. <br />KRIENKE Fahey opened the public hearing to consider the request <br />LOT SPLIT & of Dr. Krienke to divide his property at 89 West County <br />VARIANCE Road C into two lots. It was pointed out that a <br />variance is also necessary for lot area and lot width, <br />since the property is a corner lot and due to the <br />City's previous policy of requiring depths of 135 feet <br />for the lots along Rosewood Drive. It was pointed out <br />that both the Planning Commission and City Planner have <br />recommended approval of the lot split and variance. <br />There was no one from the general public present <br />wishing to comment on this matter. <br />Upon motion by Fahey, seconded by Blesener, the public <br />hearing was closed. <br />Blesener pointed out that the resulting lot would only <br />have about a 30 foot building pad for a house. <br />Blesener stated that there may be a future variance <br />request for sideyard setback as a result. <br />Mr. Blesener introduced <br />moved its adoption: <br />Page <br />the following resolution and <br />8 <br />
