MINUTES <br />CITY COUNCIL <br />JULY 24, 1991 <br />establish the line between the two properties and not <br />necessarily from the Little Canada Road right-of-way. <br />The Administrator also pointed out that Little Canada <br />Road right-of-way is somewhat confusing and it is <br />proving hard to get an accurate definition of where the <br />property line is. Therefore, the City may have to use <br />reasonableness as a best approximation of where the <br />property line is. Corrective action on the matter will <br />be taken according to City Code. <br />Blesener pointed out that the fence matter did not go <br />through the Planning Commission or City Council because <br />it was presumed that the application met all Code <br />requirements. <br />FASCIANA The City Planner reported that he has had some <br />PROPERTY discussion with Joe Fasciana about property owned by <br />his family south of the Yorkton Ridge development. <br />When that development went in the City required that a <br />road stub be left for access to the Fasciana property. <br />A portion of that road was constructed, but there is <br />still 120 to 140 feet of roadway that would need to be <br />constructed before reaching the Fasciana property. The <br />Fasciana family would like to develop one or two lots <br />and do not believe they should pay for the road <br />improvement up to their property. <br />Scalze pointed out that the road section would not <br />benefit the Yorkton Ridge property owners, and felt <br />that the new road would have to be paid for by the <br />Fasciana's. <br />Collova agreed, and pointed out that the road stub was <br />left to provide access to the Fasciana property. <br />Scalze pointed out that the situation is no different <br />than other developments in the City, such as Costa <br />Estates or Centre Place, where developers had to <br />construct sections of road to access the property they <br />wished to develop. Scalze also pointed out that a <br />temporary cul-de-sac would be needed to serve the lots <br />that the Fasciana family would like to develop. <br />The City Planner agreed that a temporary cul-de-sac is <br />needed and reported that he informed the Fasciana <br />family of this. <br />Council's consensus was that the Planner inform the <br />Fasciana family that they would be responsible for <br />development of the remaining section of road to access <br />their property which is consistent with the way other <br />developments in the City have been handled. <br />Page 7 <br />
