MINUTES <br />CITY COUNCIL <br />AUGUST 14, 1991 <br />improvement would be assessed against the benefitting <br />properties. <br />Stanke pointed out that the City issued building <br />permits in Ryan Industrial Park. <br />Collova pointed out that without the road that was <br />constructed, the property would never have been <br />developed. <br />Scalze stated that because this happened in 1974 or <br />1975 does not make it right, and the City should not do <br />the same thing again. <br />Stanke pointed out that the City came up with money to <br />assist in the reconstruction of Payne Avenue. <br />Blesener replied that in the instance of Payne Avenue, <br />those property owners paid for a road in the first <br />place. Surplus TIF funds were used to assist the <br />project, that there are no surpluses to assist in this <br />case. <br />One of the Ryan Industrial Park property owners <br />suggested that the feasibility study be put together. <br />Once cost estimates are known, the property owners can <br />discuss their legal options in view of the fact that <br />the City issued building permits for the park. The <br />property owner felt that someone needed to be held <br />liable for the situation, and felt that the property <br />owners in the park have paid their fair share. <br />Blesener pointed out that the property owners in Ryan <br />Industrial Park have gotten police and fire protection <br />services, and well as street plowing. Blesener pointed <br />out that the City has not put a road in for anyone else <br />in the City. Blesener stated that the road is a <br />private one and maintenance is the responsibility of <br />the property owners. <br />Stanke stated that the property owners in the Park have <br />plowed the streets. Stanke stated that these property <br />owners have paid their taxes and questioned what they <br />have gotten for their tax money. Stanke stated that <br />another problem is the culvert that is under Ryan <br />Drive. Stanke reported that when it rains, his <br />property is getting flooded. Stanke stated that he has <br />contacted the Watershed, who referred him to the City. <br />Hanson stated that he has looked at the culverts and <br />does not know whose jurisdiction they fall under. <br />Blesener suggested that this problem could be addressed <br />in the feasibility study. <br />PAGE 10 <br />
