MINUTES <br />CITY COUNCIL <br />FEBRUARY 26, 1992 <br />for open space and this will discourage resale of <br />properties. <br />The Planner noted that this action is before the <br />Council due to a variance request that was made for 34 <br />Little Canada Road. This action is also the result of <br />the Planning Commission not wanting to deny continued <br />use of the area as single-family. <br />Hagen again presented his concern about property <br />resale. <br />LaValle pointed out that the proposal does not effect <br />the properties' continued use as single-family. The <br />amendment of the comp plan only refers to the very <br />long-range use of the property as open space. <br />Scalze pointed out that if a house burns down it could <br />be rebuilt under existing zoning requirements no matter <br />if the comp plan is amended tonight or not. Scalze <br />pointed out that the homes on smaller lots could not <br />rebuild if they burned down regardless of whether the <br />Council amends the comp plan to designate the area as <br />future open space or not. Scalze noted that the City <br />would not be taking away any rights that property <br />owners currently have. Scalze noted that the property <br />setbacks for the area will not change. <br />Hagen suggested that they might since it is possible <br />that the County will adjust the location of Little <br />Canada Road. <br />The Planner noted that the Shoreland Ordinance requires <br />that homes along Round Lake be setback a minimum of 50 <br />feet from the high water mark. Most of the homes in <br />the area do not meet this setback. <br />Hagen stated that he was not in favor of the comp plan <br />amendment and did not understand the need for it. <br />Hagen felt that adoption of the amendment would make it <br />easier in the future for the City to rezone the <br />property. Hagen also felt it would discourage future <br />resale of the property. <br />Gloria Favis, owner of 34 Little Canada Road, reported <br />that she made application for a conditional use permit <br />and variance to make improvements to her property in <br />excess of 50% of the fair market value of the <br />structure. <br />Ed Lambert, representing Gloria Favis, asked how fair <br />market value is established. <br />Page 14 <br />
