MINUTES <br />CITY COUNCIL <br />OCTOBER 14, 1992 <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 92-10-358 - AUTHORIZING PAYMENT OF THE <br />REMAINING BALANCE FOR THE NEW FIRE TRUCK UNDER THE <br />TERMS AND CONDITIONS AS OUTLINED BY THE CITY <br />ADMINISTRATOR~ AND INSTRUCTING THE MAYOR AND CITY <br />ADMINISTRATOR TO MEET WITH TAE FIRE DEPARTMENT TO WORK <br />OUT A POLICY FOR FUTURE FIRE DEPARTMENT CAPITAL <br />EQUIPMENT PURCHASES AS DISCUSSED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Blesener, LaValle, Scalze, Collova, Hanson. <br />Nays (0). Resolution declared adopted. <br />FINAL The City Administrator reported that Kraus/Anderson was <br />PAYMENT requesting just over $53,000 as final payment for their <br />KRAUS/ construction management services at the new fire <br />ANDERSON station and City Center expansion projects. The City <br /> has paid approximately 59,800 of this amount, and has <br /> taken issue with the remaining balance. There has been <br /> considerable discussion on this subject, and the City <br /> hired an outside expert to evaluation the contract and <br /> additional payment request made by Kraus/Anderson. It <br /> was the opinion of this expert, that the additional <br /> balance was not owed to Kraus/Anderson. <br />The City Administrator reported that he has discussed <br />this matter with Kraus/Anderson, who has verbally <br />indicated that they will not pursue litigation and <br />would like to maintain their good reputation with the <br />City. Kraus/Anderson has also indicated that the <br />appropriate lien waivers for the project will be coming <br />from all contractors. The City Attorney has <br />recommended an agreement be prepared documenting the <br />terms of the final settlement as discussed. <br />Mr. Blesener introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 92-10-359 - APPROVING THE SETTLEMENT TO <br />KRAUS/ANDERSON FOR NEW FIRE STATION AND CITY CENTER <br />EXPANSION PROJECTS AS OUTLINED BY THE CITY <br />ADMINISTRATOR AND AUTHORIZING THE MAYOR AND CITY <br />ADMINISTRATOR TO EXECUTE AN AGREEMENT ON BEHALF OF THE <br />CITY OUTLINING THE TERM5 AND CONDITIONS OF THE FINAL <br />SETTLEMENT <br />The foregoing resolution was duly seconded by Collova. <br />Ayes (5) Blesener, Collova, Hanson, LaValle, Scalze. <br />Nays (O).
