MINUTES <br />CITY COUNCIL <br />MAY 26, 1993 <br />RECONSIDER <br />COUNTRY <br />DRIVE <br />ASSESSMENT <br />that the Council table action on the Mover's Warehouse <br />application for binqo hall license renewal. The <br />Attorney noted that consideration of license renewal <br />depends upon tenants, and it appears at this time that <br />Mover's Warehouse has no tenants. <br />Scalze asked how long the City could table action on <br />this matter. <br />City on May 3, 1993. <br />The City Attorney reported that the City must respond <br />within 60 days upon receipt of the bingo hall renewal <br />application, and the application was received by the <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-5-146 - TABLING ACTION ON THE RENEWAL <br />OF THE BINGO HALL LICENSE APPLICATION SUBMITTED BY <br />MOVER'S WAREHOUSE, INC. <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />its legal posture. <br />The City Attorney noted that at the workshop meeting <br />held earlier this evening, the statement was made by <br />one of the Mover's Warehouse applicants that there may <br />be litigation in the future on this issue. The <br />Attorney reported that this same statement was also <br />made to at least one Council Member. In light of this <br />fact, the City Attorney recommended that the Council go <br />into closed session following the meeting to discuss <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 93-5-147 - CALLING FOR A CLOSED SESSION <br />OF THE CITY COUNCIL FOLLOWING TONIGHT'S REGULAR MEETING <br />TO DISCUSS PENDING LITIGATION <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Aanson, Morelan, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Mr. Mark Malsam appeared before the Council asking for <br />reconsideration of the assessment levied against his <br />property for the Country Drive improvement. Malsam <br />pointed out that his property has been used as <br />residential, and he was assessed at the commercial <br />rate. Malsam also reported that in order to sell the <br />Page 14 <br />
