MINUTES <br />CITY COUNCIL <br />JULY 14, 1993 <br />property. <br />Morelan asked if rights could be assigned under a lease <br />arrangement. <br />The City Attorney felt that the agreement precluded the <br />leasing of the property as a recycling operation. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-7-212 - APPROVING THE FRATTALONE <br />DEVELOPMENT AGREEMENT AS PRESENTED AND AUTHORIZING THE <br />MAYOR AND CITY ADMINISTRATOR TO EXECUTE THE AGREEMENT <br />ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Morelan. <br />Ayes (4) LaValle, Morelan, Hanson, Pedersen. <br />Nays (1) Scalze. Resolution declared adopted. <br />BID5 - The City Engineer presented bids for the Ryan <br />RYAN IND. Industrial Park road improvement pointing out that <br />PARK ROAD the low bid received was from Tower Asphalt in the <br />IMPROVEMENT amount of $164,874, which includes an alternative bid <br />of approximately $17,000 for the Little Canada Road <br />storm sewer project. The Engineer recommended approval <br />of the bid for the Ryan Industrial Park road <br />improvement pending execution of cost-sharing <br />agreements with the property owners in the Park. <br />The City Administrator reported that Lee Rossow of <br />Comfort Bus has requested that he be allowed to install <br />storm sewer pipe through his property rather than the <br />open ditch proposed by the City. Therefore, the City <br />Administrator recommended removal of that portion of <br />the work from the bid contingent upon the City working <br />out the details of the storm sewer installation with <br />Mr. Rossow. The Administrator also pointed out that <br />the $250,000 has been set as a maximum project cost for <br />the Ryan Industrial Park improvement. Estimating <br />engineering and leqal fees, it is anticipated that the <br />project will come in below the $250,000 maximum based <br />on the low bid received. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-7-213 - AWARDING THE LOW BID OF TOWER <br />ASPHALT LITTLE CANADA ROAD STORM SEWER IMPROVEMENT AS <br />WELL AS RYAN INDUSTRIAL PARK ROAD IMPROVEMENT <br />CONTINGENT UPON RECEIPT OF SIGNED DOCUMENTS FROM 100% <br />OF THE RYAN INDUSTRIAL PARK PROPERTY OWNERS INVOLVED AS <br />WELL AS RESOLUTION OF THE STORM SEWER ISSUE WITHIN RYAN <br />INDUSTRIAL PARK WITH LEE ROSSOW OF COMFORT BUS COMPANY <br />Page 9 <br />
