MINUTES <br />CITY COUNCIL <br />OCTOBER 13, 1993 <br />WRITING OF THE CITY'S INTENT TO REBATE ANY <br />OVER-ASSESSMENT FOR THE PROJECT SHOULD SUCH <br />OVER-ASSESSMENT OCCUR <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Hanson, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />CABLE TV Hanson reported that a resident has contacted the City <br />stating that last night's special meeting on <br />assessments should have been broadcast on Cable TV. <br />Hanson asked the Council if they wanted to consider, as <br />a matter of policy. to consider broadcasting all <br />special meetings where action can be taken. <br />Mrs. Scalze introduced the following resolution and <br />moved its adoption: <br />RESOLUTION NO. 93-10-336 - DECLARING THAT CITY POLICY <br />IS TO BROADCAST ALL COUNCIL SPECIAL MEETINGS ON CABLE <br />TV AS WELL AS COUNCIL BUDGET WORKSHOP MEETINGS <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (5) Scalze, Pedersen, Hanson, LaValle, Morelan. <br />Nays (0). Resolution declared adopted. <br />SCUI,LY Mr. John Scully appeared before the Council. Scully <br />PROPERTY noted that recently he applied for a Conditional Use <br />Permit to construct an over-sized garage. As a part of <br />the approval of the CUP, the Council required that a <br />road easement into his property from Beam Avenue be <br />dedicated to the City. This was originally a <br />requirement that was made when a portion of the <br />property was subdivided in 1980. Scully reported that <br />the permit for his garage had been held up pending <br />dedication of the road easement. He was informed by <br />City staff that he would have to pay to have his <br />property surveyed, and have a legal description drawn <br />up, and pay for recording of the road easement. Scully <br />reported that he was required to pay an additional $500 <br />for this road easement work. Scully pointed out that <br />the easement was originally required when his father <br />divided the property in 1980. The City accepted the <br />easement at that time, and as far as he was concerned <br />from that time forward the property belonged to the <br />City. If the City made a mistake and did not get the <br />paperwork recorded, that was the City's mistake, and he <br />should not have to pay the cost now. <br />Hanson pointed out that if an easement did not get <br />recorded due to negligence on the part of the City, <br />then the City should not hold up Mr. Scully. <br />Scalze asked if it was negligence on the part of the <br />City that the easement did not get recorded. <br />Page 20 <br />
