MINUTES <br />CITY COUNCIL <br />JULY 13, 1994 <br />MORATORIUM Council meeting there were some comments made by <br />individual Council members regarding the types of uses <br />allowed in the B-3 zoning district, and whether or not <br />certain uses were appropriate in the Rice Street <br />redevelopment area. As a result of those comments, <br />staff asked the City Attorney to prepare an ordinance <br />which would place a development moratorium on the Rice <br />Street TIF redevelopment area. Enacting a moratorium <br />would give the City time to study the permitted and <br />conditional uses allowed in the B-3 district. <br />Morelan pointed out that the moratorium is a way to <br />curtail development in the Rice Street redevelopment <br />area until there is some sort of direction for the <br />redevelopment project. <br />Hanson pointed out that it has been a year since the <br />redevelopment of Rice Street has been proposed and the <br />TIF District established, and the City has not been <br />presented with any proposals as of yet. Hanson stated <br />that he did not want to see the potential for <br />development curtailed, and asked if it would be <br />difficult to rescind a moratorium once it is enacted. <br />The City Attorney stated that the Municipal Planning <br />Act allows enactment of a moratorium for up to 12 <br />months with the possibility for an 18 month extension. <br />The Attorney stated that should the Council decide to <br />enact the moratorium, and should redevelopment plans <br />for the area be closer to completion, the Council could <br />at any time lift the moratorium or remove any <br />individual parcels from the moratorium. This could be <br />done by simple majority vote of the Council. <br />The City Administrator reported that the City has not <br />been presented with any development proposal for the <br />Rice Street redevelopment area. The Administrator also <br />pointed out that the developers who have been working <br />on a redevelopment project, have not requested the <br />moratorium. The Administrator stated that from a <br />planning perspective and given the other development <br />which could occur and possibly affect the redevelopment <br />of Rice Street, a review of B-3 uses is important. <br />Hanson asked if a public hearing was required before a <br />moratorium could be enacted. <br />The City Attorney replied that under the present <br />6 <br />
