MINiITES <br />CITY COUNCIL <br />NOVII~SBER 9, 1994 <br />property owners. Morelan felt that was fair provided <br />that the property owners are willing to go along with <br />it. <br />Hanson questioned how the City would determine who <br />would benefit from the wall improvement. Hanson <br />questioned the benefit to a property owner just because <br />they pass through the wall area. <br />Scalze stated it was her feeling that the wall was part <br />of the whole road system for the area. <br />Hanson stated that he would like to see the wall <br />improved at City cost and be done with the matter. <br />Hanson did not believe the wall improvement would pass <br />the benefits-received test should the City assess the <br />cost. <br />The City Administrator agreed that the benefits <br />argument would be a difficult one, but felt it could be <br />assessed on an area approach similar to a storm sewer <br />system improvement. The Administrator pointed out that <br />the wall delineates the entrance to the area. <br />Hanson was concerned that there would be an erosion <br />problem if the existing wall were removed and the area <br />merely sloped. <br />Morelan pointed out the estimated maximum cost of <br />$25,000. A 50/50 split of that cost would not amount <br />to a large assessment per parcel. <br />Mr. Jack Desai, 2404 Dianna Lane, appeared before the <br />Council and read his memo dated November 9th on the <br />Dianna Lane retaining wall. In that memo Desai claims <br />that the retaining wall is the responsibility of the <br />City. Therefore, the City should bear the full cost of <br />replacing the wall. Mr. Desai's recommendation at the <br />conclusion of his memo is that the City adopt either <br />Option A or B from the November 4th report of the City <br />Engineer and bear full costs to correct the result of <br />17 years' negligence of the City because it is the only <br />fair and equitable resolution of the problem. <br />Morelan stated that he agreed, and that the only <br />question was which option the City would choose. <br />Hanson felt that there were disadvantages to Option B <br />11 <br />
