MINUTES <br />CITY COUNCIL <br />MARCH 8, 1995 <br />requirements, it is pretty tough to get a variance to <br />the Subdivision Code. However, it has been the <br />Attorney's experience with city councils in general <br />that they do not strictly apply those criteria. <br />Scalze pointed out that the Subdivision Code talks <br />about the effect on the vicinity. <br />Pedersen indicated that it sounds like the Council can <br />be more discretionary based upon the reality of the <br />area. <br />Morelan felt that the more discretionary it is, the <br />better to have a super majority requirement. <br />Fahey felt that the issue of whether a super or simple <br />majority is required must be resolved. Fahey suggested <br />that the Council review the various sections of both <br />ordinances and be prepared to discuss it at the next <br />meeting. <br />The City Administrator pointed out that Mr. Tima is <br />planning to make application for a lot split during the <br />City's April cycle. Therefore, the Council can discuss <br />the issue again at its next meeting. If it decides the <br />ordinance should be amended, there is adequate time to <br />do so before the Council acts on the Tima lot split. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-3-72 - TABLING ACTION ON THE ISSUE OF <br />NUMBER OF VOTES REQUIRED FOR VARIANCES TO THE ZONING <br />CODE AND SUBDIVISION CODE UNTIL THE NEXT REGULAR <br />COUNCIL MEETING <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Fahey, Pedersen, Morelan. <br />Nays (0). Resolution declared adopted. <br />The City Attorney reported that an amendment of the <br />Zoning Code will require a super majority vote. An <br />amendment of the Subdivision Code will require a simple <br />majority vote. <br />8 <br />
