MINi7TES <br />CITY COUNCIL <br />M71RCH 22, 1995 <br />motion was seconded by LaValle. <br />Scalze pointed out that an amendment to the Subdivision <br />Code does not require a public hearing nor review by <br />the Planning Commission. <br />Fahey stated that he would support this amendment if <br />the Zoning Code is also amended to require a simple <br />majority vote for variances. <br />Scalze pointed out that the a public hearing and <br />recommendation from the Planning Commission is <br />necessary for changes to the Zoning Code. <br />Fahey suggested that Little Canada should be consistent <br />with what other cities are doing. Fahey also felt that <br />the amounts of votes for variances under both <br />ordinances should be consistent. <br />Mr. Fahey moved that action on the Subdivision <br />Ordinance be tabled until a recommendation can be <br />obtained from the Planning Commission on both the <br />Subdivision and Zoning Ordinances. Motion seconded by <br />Morelan. <br />The City Attorney noted that the motion to table would <br />take precedence over the motion to amend the <br />Subdivision Ordinance. <br />Pedersen pointed out that because of an inconsistency <br />in the Subdivision Ordinance, it takes a weighted <br />majority to approve variances even though it appears <br />the intent was for a simple majority. Pedersen <br />suggested that this inconsistency be clarified at this <br />time, and the issue of weighted versus simple majority <br />for both the Zoning and Subdivision Ordinances be <br />addressed at a later date. <br />LaValle asked why Fahey opposed the clarification of <br />the 5ubdivision Ordinance at this time. <br />Fahey replied that a variance under either ordinance <br />has an equal impact on affected property owners. <br />Morelan felt there was very little difference between <br />the two ordinances, and agreed the issue of the vote <br />should be consistent between the two. Morelan felt <br />there was validity for requiring a weighted majority to <br />16 <br />
