MINUTES <br />CITY COUNCIL <br />APRIL 26, 1995 <br />RESOLUTION NO. 95-4-115 - ADOPTING TI-IE MISSION <br />STATEMENT FOR THE CITY OF LITTLE CANADA AS AMENDED <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Pedersen, Scalze, Fahey. <br />Nays (0). Resolution declared adopted. <br />VOTES Fahey pointed out that the Planning Commission has <br />REQUIRED recommended that a simple majority vote of the Council <br />FOR ZONING/ be required for approval of variances to the <br />SUBDIVISION Subdivision Code and for variances and conditional use <br />VARIANCES permits to the Zoning Code. <br />AND CUP'S <br />Scalze pointed out that State Law requires a weighted <br />majority of the Council approve rezoninqs and changes <br />to the Zoning Ordinance text. Scalze stated that she <br />would not want to see the variance process used to by- <br />pass that requirement. <br />Fahey replied that that is a good reason to require the <br />weighted majority for rezonings and text amendments. <br />Morelan suqgested that changing the vote requirement <br />may result in a request for a CUP in a B-3 District for <br />rather than a rezoning to B-2 for something that is a <br />permitted use in the B-2 District. Morelan stated that <br />he was against changing the vote requirement for <br />variances and CUP's under the Zoning Ordinance. <br />Morelan felt that variances were permanent changes that <br />require good justification. Therefore, the weighted <br />majority vote ensures that the right decision is being <br />made. <br />LaValle pointed out that the surrounding communities <br />require a simple majority. <br />Morelan pointed out that the City Planner has indicated <br />that the weighted majority is not out-of-line with what <br />is required in the Metro area. <br />LaValle pointed out that Little Canada competes with <br />its surrounding communities, and felt requirements <br />should be similar. <br />Fahey agreed that Little Canada should be in sync with <br />surrounding communities. Fahey also pointed out the <br />stalemate the Council can get into because of the four <br />21 <br />
