MINUTES <br />CITY COUNCIL <br />MAY 24, 1995 <br />CUP FOR Mayor Fahey opened the Public Hearing to consider the <br />ACCESSORY application for Conditional Use Permit to allow more <br />BUILDING - than one accessory building on a property and to allow <br />FRATTALONE total accessory building area to exceed 1,000 square <br />feet as requested by Mr. Myers Frattalone for property <br />at 2933 Centerville Road. Fahey noted that the City <br />Planner recommended approval subject to compliance with <br />the recommendations as outlined in his report dated May <br />3, 1995. The Planning Commission also recommended <br />approval subject to these same conditions. <br />Mr. Frattalone reported that he has reviewed the <br />Planner's report and understands the recommendations. <br />There was no one present from the general public <br />wishing to comment on this matter. <br />Upon motion by 5calze, seconded by Morelan, the public <br />hearing was closed. <br />Mr. LaValle introduced the following resolution and <br />moved its adoption: <br />RESOLUTION N0. 95-5-134 - APPROVING A CONDITIONAL USE <br />PERMIT ALLOWING MORE THAN ONE ACCESSORY BUILDING ON A <br />PROPERTY AS WELL AS TOTAL ACCESSORY BUILDING AREA TO <br />EXCEED 1,000 SQUARE FEET AS REQUESTED BY MR. MYERS <br />FRATTALONE FOR FiIS PROPERTY AT 2933 CENTERVILLE ROAD <br />SUBJECT TO COMPLIANCE WITIi THE RECOMMENDATIONS OF TI-IE <br />CITY PLANNER AS CONTAINED IN HIS REPORT DATED MAY 3, <br />1995 <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Pedersen, Fahey, Morelan. <br />Nays (0). Resolution declared adopted. <br />AMEND ZONING Mayor Fahey opened the Public Hearing to consider <br />CODE - VOTES amending the Zoning Code to allow the approval of <br />NECESSARY Variances and Conditional Use Permits by a simple <br />FOR VARIANCE majority of the City Council. Fahey noted that the <br />& CUP'S Council recently clarified the Subdivision Code, and a <br /> simple majority vote of the Council is required to pass <br /> variances to that Code. Fahey also pointed out the <br /> survey conducted by City staff which shows that every <br /> city in the northeast metro, except for Falcon Heights, <br /> requires a simple majority vote to approve Variances <br /> and Conditional Use Permits. Changes in Zoning <br /> Ordinance text and Zoning District boundaries would <br /> require a weighted majority vote of the Council for <br /> approval. Fahey recommended adoption of the amendment <br /> as proposed, pointing out that the change would make <br />2 <br />
